If your writing to FOS, Margaret O'Keefe at FOS says they'll look at any claims to put people in the same financial position the person would be in if not for Amex's delays. So if you were, for example, now finding you can't book qff award flights to, say, SanFrancisco in January school holidays in 2010, they'll look into cash flights. Are bus and cattle class full?

Qff on my dates and routes said 'zilch' seats, except up the front. I'd happy let Amex poc me at the 'cattle class rate' for business or first class seats. Heck, I'll fly economy a week earlier if they put me up at a hotel. They can dock Corinna's Xmas bonus.

Plus the fact that QFF is an external entity, the promotion was for AMEX points; not QFF points.

How can people seriously justify fighting on something they "might have been able to get with QFF"? Absurd :rolleyes:

They can't justify it but the story keeps changing like Amex's inconsistency in this promotion.

Originally it was not being able to transfer to Velocity with the 25% bonus in November and the kids would be deprived of a holiday to Disneyland but now it appears there is no QFF availability in Jan 2010 in the premium cabins and the kids are again going to be deprived of their dream (yearly) holiday to Disneyland.

I am stumped as to what relevance these claims have to do with Amex or this promotion....

Thanks JohnK, I was going to mention the exact same thing eg. the early quibble around the Velocity promotion. The thing I find funny is all the people that were trashing a certain someone earlier in the thread about how he kept referring to this promotion as a QFF promotion, and how so many people pointed out that "It's an AMEX promotion, it has nothing to do with QFF". But I digress..... :rolleyes::rolleyes:
 
You are welcome to disagree with views put by named officials who will take calls from anyone who wants general views on what these bodies will look into and might award. Anyone who wants to enquire further can contact the named officers at Fos and ASIC.
 
Getting a classic award redemption during January school holidays is always a tough proposition, and would need to be snapped up pretty quickly when they became available. Given the 8-10 week time frame that Amex quoted for posting points, I would have thought the chances of the stars aligning on this pretty remote.
 
Anyone wanting to justify compensation for missing out of award flights due to delayed payment of bonus points would need to be able to prove that the award flights were actually available for booking at the time bonus points were supposed to be issued.

Personally I believe such compensation claims should not be considered. However, if Amex prolong the process I may be asking for reimbursement of direct costs incurred in resolving the dispute, such as postage and STD fax costs (I was only provided an STD number and asked to fax documents that I had already sent via registered post!). So far my tally is around $10 of direct costs.

Yeah, I was pretty confused. luckily Amex had views similar to the commission's inspector and fos.
 
glad to see that some people are still taking everyone's posts as personal insults
and that some people are taking this so seriously that a fake points page obviously meant as a joke sparks 50 flames back

c'mon, that page was hillarious, you can laugh at it or go lose some sleep over it, but hey it's your choice.

Anyway I rang Amex this afternoon....

I was put through a very harried sounding "Jamie" in MR Rewards after explaining to another rep after I had rung to see whay they had not replied to me within their own specified 30 day period.

Initial response was quite interesting.

Amex: "As you were advised this morning a letter will be mailed today to you today"

Me: "But I did not speak with anyone at Amex this morning...so can you tell me what you thought you had already advised me of this morning?".

"Jamie" then sounded more "harried" as we got into a discussion.

Amex: "We will mail you a letter today, but I am not able to tell you what the letter contains"

Me: "Why not?"

Amex: "I am not able to tell you that, but you will receive a letter within 7 days"

Me: "Why 7 days, where are you?"

Amex: "Sydney"

Me: "Good as you are mailing it today I should get it within two days"

Amex: "No it might take up to 7 days"

Me: "Why?"


...and so on and so forth....

I ended up advising Jamie that I took his advice of 7 days as a guarantee and advised him if not received that Amex would be in breach and so I would have to contact the BFSO about it.


Anyway it sounds like a batch of letters is about to go out....

I wonder if they will be personalised....or whether they will be "form" letters?

I also gained the impression from the tone in Jamies voice that he was thoroughly sick and tired of being the Amex bunny that was obviously dealing with a stream of similar calls.
 
As I've already posted, I received 50k points yesterday that did not seem to relate in any manner to the number of transactions I did for Nov. Today I've received another batch of 220k notated "Spend Promotion - Dec" which in no way matches the transactions I did in Dec. It seems I've been way underpaid for Sept/Oct/Nov and overpaid in Dec, but still leaves me around 100k short (I'm on 5/5).

At least there are some points posting though!
 
I've just been paid in full.
December bonus points have arrived in my MR account today.:D:D
 
Another batch arrived here as well... Now to work out the sums - but Amex has been particularly generous from what I can see..

I have also received Dec bonus points this evening..... a more generous allocation of points than I was expecting :) Lets hope I get to keep them this time and I don't get POCd again.
 
December points just landed here as well.

Overall for Sep/Oct/Nov/Dec I appear to have been short changed 5,000 points, however given that this is out of almost 500,000 bonus points awarded I am leaving it at that.

Whilst not impressed with the way in which Amex handled this whole promotion and the debarcle they caused themselves, and to us cardholders, I am happy I have got what I have and will leave it at that.

For those that havent got the latest batch of points I wish you luck, obviously there are channels out there which will offer assistance (given that the only reason I got any points was intervention by the BFSO).

Just as an academic exercise, I think It would be rather easy to justify a claim of missing out. It would depend of the fact that QFF is a separate entity, IMO. So in general (hand waving terms) the justification chain of proof would have to be something like:


  • AMEX offers the promo with T&C including payment in 8 to 10 weeks.
  • One accepts the promo
  • One does all the required things within the T&C to earn X points.
  • At 10 weeks and 1 day - no AMEX points
  • At 10 weeks and however many days it takes to transfer the points to QFF - QFF shows that Flight Y is available and the missing X points are required to buy that flight - at this point the desired flight is locked in.
  • The points post, one transfers to QFF and flight Y is no longer available when the points arrive.
  • A fairly clear connection between not getting flight Y because AMEX didn't meet the T&C.
So IMO justification is easy. It works because you are getting QFF points from AMEX, not a flight. So by not meeting the timing AMEX have prevented you getting X QFF points (which is a non variable redemption).

However, measuring the loss is a completely different question. What has been lost? I don't know. I think compensation falls over at the point of assigning a value to points which technicially have no value.

I've been keeping a spreadsheet tracking transactions, it is doersn't match any of the 3 promos.

Looks like a phone call tomorrow night once i get settled in BNE
