Intoxicated and aggressive Business Class Passenger - JETSTAR

Following a recent Jetstar Business Class flight from Bali to Brisbane, my wife encountered a faulty seat in 1A. Despite notifying the aircrew, the seat malfunctioned, causing it to recline abruptly and the footrest to remain unresponsive. Unfortunately, due to capacity constraints, we couldn't be relocated.

During the flight, my wife reclined her seat after the meal service, inadvertently causing the individual in seat 2C (behind me, not behind her in 2A) to spill his wine. This passenger, who was visibly intoxicated and aggressive, retaliated by throwing the remaining wine at my wife's face. An exchange of words ensued, and we sought assistance from the aircrew and the Pilot, who handled the situation professionally. Subsequently, the aggressive passenger was removed from the plane upon arrival by Federal police. We also considered pressing charges for assault.

Considering these circumstances, should my Wife be compensated by Jetstar? and if so, how do we go about it?

I'm truly sorry to hear about your wife's distressing experience during the recent Jetstar Business Class flight. It's important to address such incidents and emphasise that any form of assault is unacceptable in today's society, especially considering the potential risks of viral and bacterial transmission via his drink being thrown in your face.

Given the circumstances, it would be entirely appropriate to consider compensation from Jetstar for the distress and discomfort your wife endured during the flight. To initiate this process, I recommend the following steps:
  1. Document the Incident: Compile a detailed account of the incident, including the date, flight number, seat numbers, the sequence of events, and any conversations with the crew or other passengers involved. It's crucial to have this information as evidence.
  2. Contact Jetstar Customer Service: Reach out to Jetstar's customer service department through their official channels. You can typically find contact information on their website or booking documents. Clearly describe the incident and express your concerns regarding your wife's well-being and safety during the flight.
  3. Include Legal Action as an Option: Mention that you are considering pressing charges for assault. This may underscore the seriousness of the situation to Jetstar.
  4. Request Compensation: In your communication with Jetstar, be clear about your expectations for compensation. This could include reimbursement for any costs incurred due to the incident, as well as compensation for your wife's distress.
  5. Maintain a Record: Keep records of all correspondence with Jetstar, including emails, phone calls, and any responses you receive. This will be valuable if you need to escalate the matter further.
  6. Seek Legal Advice: If Jetstar's response is not satisfactory, consult with a Lawyer to explore your options regarding pressing charges for assault and pursuing a compensation claim through legal means.
Remember that safety and well-being should be a priority for all airlines, and Jetstar should take this incident seriously. Your wife deserves a resolution to this distressing experience, and pursuing the appropriate channels for compensation and legal action, if necessary, is a step in the right direction.

For the seat issues, yes...for the issue with 2C, no.
Not so fast? But JQ need to provide a safe environment which ought to include monitoring pax and their alcohol intake. Seeing as though they served at least one alcoholic drink to 2C they've contributed to his condition and actions. Perhaps a comparative example to illustrate my rationale may be that Dr guy that was injured on the United flight. He received a settlement from United not the law enforcement agency.

The assault was by the passenger, so any charges would need to be against the passenger.

Agree, but an establishment serving alcohol has some culpability if they keep serving alcohol to an obviously intoxicated person (and that will be the rub) and the person then commits an assault (or similar). Not perhaps to the level of 'charges' though.

Given the fact it reads identical a typical response from the chat bot, one would be forgiven to think it's from there. No biggie.

In a perfect world people would be responsible for their own behaviour but this is very much an imperfect world and that responsibility often has to move up the chain. All the arguments put forward in this thread seem reasonable.

I'm just sorry you were treated that way by another human.

I think Jetstar has contributed in two ways:

1. Continuing to serve alcohol to an already intoxicated pax who then acted aggressively towards another pax.
2. Providing a faulty seat, the malfunctioning of which, led to the intoxicated pax spilling his drink in the first place.

Perfectly reasonable to request recompense from Jetstar. Perfectly reasonable to consider pressing charges against pax.

Do we know JQ was serving alcohol to an already intoxicated passenger? Isn’t this supposed to follow RSA guidelines, which is a visible effect of intoxication? Otherwise everyone would be cut off after a single drink!

If the pax knew the seat was faulty, did they take sufficient care in reclining?

I don’t see how a seat reclining, 1A into 2C, could cause a drink to spill? The seats aren’t close enough for that in ordinary use. Tray tables are in the armrest, so can’t be affected by recline. Centre console is nowhere near close enough. What was 2C doing?

I'm not sure if my input helps, but I've accidentally done the same thing to a pax behind me on JQi 787 business class.

I went to recline my seat a little well after the meal service was over. The problem seems to be that with some JQi 787 J class seats, when you just want to recline a little, the seat jerks back into fully reclined mode.

In my case, my seat recline hit an object on the meal tray, that I think was pushed forward, of the pax behind. Maybe it was a laptop? They can be pretty high objects on the tray. Maybe it was glass? But whatever it hit, a drink of the pax behind then got spilled.

I could imagine that a laptop, if hit when on the tray, could then hit a glass elsewhere on the tray or on the armrest console?

I apologised as much as I could to the pax behind. And the crew mopped up.

Diagonally behind?

No - it was directly behind.

But the pax directly behind was using the meal tray for other reasons than the meal.

And it seems a seat recline of the forward seat CAN hit objects on that tray - if those objects are high enough. And (maybe) if the tray is pushed fully forward?

I'm not entirely sure, but it happened!

Regardless, hit an object that causes a glass spill and who knows where the spill will go? Down, yes but maybe left or right first?

Well, it is Jetstar! I thought J class trays were not attached to the seat back in front?
