Dan Murphy's and Other Wine Deals

It's not a question of rectification. As I understand the background, you accepted their offer to purchase 4 bottles for a certain price. They delivered only 2. It is a question of performance of their obligations under that contract; viz delivering 4 bottles.

This has already been discussed - when CM put an "x12" symbol on their wine, they mean 12 bottles. When they put "x2" it means two bottles. Not two packs, two cases or two pallets. Obviously that might be interpreted otherwise by the reader.

I haven't seen the terms of the offer, but what CM intended to offer is strictly irrelevant. If the objective interpretation of the offer is that 4 bottles were offered and Dr Ralph accepted that then there is a contract. But the converse is true too.

Some of this is just getting silly. Having purchased from CM before and being familiar with their ads, I read the ad in question as CM intended (2 bottles all up). I hardly think it was intentional deception that someone interpreted it differently. I think the return/refund is perfectly acceptable...move on.

Hardly available anywhere else on the market, the cheapest I can see it anywhere online is [/FONT][/COLOR]$68. To snap up this sensational wine for over half price at just $36.99/bottle . I only have 40 six packs so it won’t last long!

The say 'twin pack' and then they write x 2 in a grey circle. To me this indicates that there are 2 x twin packs which happen to have 2 bottles in them.

They do however list 'From 14.99 a bottle' for a total price of 29.98 (using the Dorrien Estate Twin Pack as an example).

But that logic doesn't work.

Look at this item:

It clearly says 'twin pack' x 1. Therefore there is 1 x 2 items for a total of 2 items.

If you write 'twin pack' x 2 then there must be 2 x 2 items for a total of 4 items.

Sorry Dr Ralph that you seem to have misinterpreted Cellarmasters :(

With beer/wine/spirits/water, x2 means the deal is for 2 bottles, and a per bottle price is given

With glassware/accessories, x1 means the deal is for 1 pack, which might include 2 items, and a per pack price is given - unfortunately, in these cases, a pack is listed as equivalent to a bottle - don't know why they can't replace the word bottle with pack?

What remedy do you want and expect given that they might be genuine errors, reasonable mistakes of fact, with no intent to mislead or deceive?

Sounds dodgy. Contact dans and see if they can tell you which credit card was used.
 
These days I prefer ordering with First Choice Liquor (Coles) on line. Free delivery for orders over $150, even to NSW Far South Coast. The more you drink the more you save!!
 
I was about to bite, but checked wine companion and Halliday rated this a 86! Might explain the steep discount.
