European flight delay compensation

Seeking clarification on the usage of this.

I recently had a flight on Icelandair from IAD-KEF. We boarded, sat on the tarmac for 2 hours, then told of a mechanical issue which could not be resolved.

We we're put up in an airport hotel overnight then boarding essentially the same flight (though rebooked under a different flight number) the following day.

Given this situation, are we able to claim compensation for this occurrence?

I am an amateur with regard to this, but to me you certainly seem to be entitled to compensation under EU261/2004 legislation - at 600 euro each. You can have a read of the Icelandair compensation pages at Flight Disruptions Claim Form | Icelandair

Thanks for your reply. I had submitted a claim under this form a month ago, but yet to receive a response.

Given that we do not feature under the enforcement bodies under EC261, I'm not sure who next to contact. (https://ec.europa.eu/transport/sites/transport/files/2004_261_national_enforcement_bodies.pdf)

I guess you have contacted Icelandair to see what is happening? I seem to remember some threads on FlyerTalk about 6 week delays but can't really find the results.

Of course there are always companies like Icelandair Cancelled / Delayed Flight Compensation who will follow up a claim for you - but thay will take their cut of any payout. Disclaimer: I know nothing about "Claim Flights" they just came up in a search - there are plenty of other similar operators.
 
As a layman reading the material, you seem to be covered by EC261. Iceland is included in it, your flight was >3500 km and delay >4 hours, leading to compensation of 600e. But it seems to be a habit that the airlines are in no rush to pay out the compensations. Stick to it or see if you'd like to hire a 3rd party to represent you in the hope they can provide the payout quicker (less their fees).
 
You are entitled to compensation as Icelandair is based in the EU. (If you had been flying a US-based airline, you would not be entitled to compensation as the flight did not depart from the EU.)

If you don't hear back from Icelandair soon, or they deny the claim, I would just go straight to a third party to get the compensation on your behalf. They'll take a cut of the payout, but it's still probably worth it IMHO.
 
Either one of the claim companies (who are actually pretty good, but take around 1/3), or you pursue it yourself direct with the airline. It took us just on a year of back and forth with EK to get paid out, and we had to be persistent, respoding to three or four denials of liability.

Each email response took about 10-15 minutes, plus a bit of research. So all up a couple of hours to get us the 600 instead of 400 via a claims company.

25% commission sounds a bit much but if they can handle all the back and forth I think its ok.

I would still follow it up with another email on your own accord before resorting to the claim company. 25% is still $200 for five minutes work, and nothing to lose on your behalf.
 
For reference use by others, I was delayed on QF10 on 12 Apr, rerouted onto QF2 - delay c9 hrs
Applied through customer care for EC261 compensation on 14 Apr
Received a response from Qantas Customer Care on 29 Apr with a payment form. 600EUR amount agreed.
Received confirmation of processing from Qantas on 31 Apr... apparently up to 10 days for payment to arrive
 
Oh that's great news. I was hoping Icelandair would be faster getting this done.

Have just received notice from Icelandair that they have received the request and will process it in due course.
 
Just received EU600 from Etihad for a 17 hour delay from Rome FCO to Jakarta CGK, which resulted in a missed connection in AUH, so another 15 hour layover, plus my luggage missed the connection so after 8 hours staying awake at the airport waiting for it on the next flight. They also provided two hotel stays at each airport and lunch and dinner at each.

They were looking at other options for me such as a earlier flight to to Singapore from Abu Dahbi, but seeing that it was the tail end of Easter everything was overbooked/wait-listed.

In the end I missed a day of work arriving back late, worked from home the next day as well, had to change my Singapore airlines connecting flights at a cost of $550 (and downgrade from Business) but got $250 back to travel insurance.

The ticket was a $2k business class special return so they couldn't have made money off that with the two visits to the First Class lounge each way as well.

My case seems to be at the extreme end of things so they seemed happy to send me a release letter and get it paid out.

They offered either the 600EU compensation or 780EU travel credit valid for 5-years, just took the 600EU.

All wrapped up in around 3-months, so not too bad in regards to responding to the request for claim.
