Hi Everyone,

Back in January Mrs Pozza signed up for the Amex Platinum Reserve in order to use the free flight for a girls weekend to Bali and also the 30,000 bonus points.

It has now been 10 weeks and the points haven't arrived as per usual with Amex :), so we have emailed them. They came back quoting the terms and conditions are that the bonus points are for new Amex customers only, having gone to their site I notice this is the new wording of the offer ending this month for the points. However the wording back in January was definitely "This offer is only available to new Platinum Reserve Credit Card members" because we checked it before proceeding. Stupidly it would appear that we didn't take a copy of the page or have misplaced it though.

It is probably a long shot but does anyone have a copy of the terms and conditions from January this year?

Cheers,
Pozza

They changed terms time and again in this promo http://www.australianfrequentflyer....proaches-claim-5-000-a-59475.html#post1030495. Those who went to fos.org.au finally received a mish mash of points and FOS can report them to the ASIC if Amex do indeed change the deal after signing people up.

You've given Amex 10 weeks so call fos Then amex might take you seriously instead of fobbing you off.

Have you used 'time machine' to see what the old terms were?

I might somewhere... away for the Easter break so will have to check when back home.

Thanks everyone I didn't need it in the end. They conceded and gave the points

They've received a notification from fos, i heard, about changing terms on a whim.

Nice to see Amex gave the points without the need to go to the FOS, ASIC Misconduct & Breach Reporting, or ACCC.

These 'retroactive' terms are too common: why can't they get these things right on day one like that infamous myreward and earnbonus promo?

Just fyi Free v Jetstar Airways Pty Ltd (Civil Claims) [2007] VCAT 1405 (27 July 2007) is an interesting case about terms not in plain view enough. Jetstar lost iirc.

This was about name changes. Jetstar lost the case, bit the ruling was overturned on appeal.

http://www.australianfrequentflyer....etstar-public-relations-16272.html#post218720 is an old thread that says
the Director of CAV challenged Jetstar in the Vic Supreme Court ver a $600 refund. JetStir relied on some words in the Act to make it hard for consumers to win. the case goes back to VCAT. Meantime the Vic Parliament is removing the words. So too are the Australian Council of Govts from other laws. So please keep our streets safe for jetsetting grannies and complain to Consumer Affairs too. After a while, the toothless regulators get claws if there's enough complaints.

The real issue for the OP is Amex 'backdating' changes to their offer to cut out people who qualified. And sometimes the retrospective changes backfire.
