Does one ask for an op-up or does it just happen as if by magic?

But to answer the question at face value. I've asked many times and been allowed to sit in business, after I've allowed them to remove points from my account.

We were opped up on a classic award booking at the gate in Singapore. I was worried about the unusual sound at the scanner to board but Mr P had a grin.
 
When I took my LTG flight which was ADL MEL, I took boxes of chocolates with me (from a WW EDR special :) ) and I gave one of the boxes to the ADL QP staff to celebrate. They then came to see me later in the QP to offer me an upgrade. Trouble was, I was already in 2C ;)

Anyway, my point is, if you are nice to them, you never know what they might be able to do. Just asking however is unlikely to do it IMO, no matter how polite you are.

That's a fair point. I made a joke about my failure to read very early one morning in AKL at the Qantas lounge. Same person scanned me onto the plane and was pleased to note I had been upgraded.

But still I didn't ask, it happened as if by magic.

I cannot see how this could be construed as bribery in the australian jurisdiction. Even if it was a government official, considering it was likely less than say 20 bucks, id be suprised if anyone saw it this way. And of you were qf, would you want one of your top tier to be embarresed because you didnt take a few chocolates?

hmmm maybe emirates is bribing me when they offer opups...

When dealing with procurement areas in the Federal Public Service you are not able to give even a $6 box of chocolates at Christmas.......There is a total ban on gifts at any time of any value.

just an example of how a small gift in the Australian jurisdiction can be considered a bribe. :) Mind you there seems to be no problem with Qantas handing out CL memberships like confetti to senior public servants - one rule for the bosses another for the workers :)

The act of giving chocolates in itself is not bribery. The act of giving an inducement to employee of a company (the chocolates) to get something in return from that employee which the customer would not normally get otherwise (an upgrade to J) is bribery in any country. Bribery does not need to involve money and can be of any value.

I am not saying that bribery was intended when the chocolates were given but it ended up that way.

Most large corporates are conducting mandatory training on this and we do it on a yearly basis.
 
I believe the chocolates were to celebrate LTG with others, and the OP up was in recognition of LTG. ;)

What utter rubbish. Nothing was asked in return for the gift and nothing was given, or could even be given. Then there is the fact that a private company can do whatever they want if it doesn't break the law.

Qantas is not the public service. A box of chocolates given to Qantas is not going to potentially result in advantage for gaining public money and potential misuse of taxpayer funds.

But that sounds like a ludicrous rule. $6 of chocolate is not going to influence a decision, especially if the gift is declared. I had to put up with this cough of driving for 3 days because the company flying us to the middle of nowhere on their private plane was going to bribe me. :rolleyes:

I did note that, but the J upgrade offer was made by the QF staff member only after giving the chocolates, which you may have taken if you were not travelling in J already. I also acknowledge that you did not offer the chocolates to receive something in return.

My point, which I may have not made very well, was that the post indicated that if you do something for the QF staff in the QP you can get something in return.

Thank you :) As you are clearly an intelligent person ;) , I'm going to do something I don't normally do on a forum and engage in sensible legal discussion with you. In my view the other element (apart from intention) that is lacking for it to be bribery is the element of expecting the staffer to keep whatever is proferred secret.

In other words, in the ADL QP example and assuming SA law would apply to it, it would only constitute the offence of bribery if the choccies were handed over with words like "here you go, keep these to yourself but if there's any space in J I'd love you to put me in it, just keep it between us though".

Dunno about other states, maybe they don't have the secrecy element in their bribery legislation. I also can't be bothered looking into the Cth Crimes Act right now - the airport is Cth land and it might apply ;)
