The party has started-
Qantas launches court action over Rolls-Royce A380 engines | QF32
Qantas has increased pressure on Rolls-Royce to reach a commercial settlement over problems caused by the manufacturer's A380 superjumbo engines by launching a court action.
The airline issued a statement today saying it had filed a statement of claim and was granted an injunction by the Federal Court of Australia to ensure the company can pursue legal action against Rolls-Royce in Australia, particularly under the Trade Practices Act, if a commercial settlement is not possible.
It is believed the costs incurred by the grounding of aircraft could be $100 million.

So QF goes after RR as DJ went after Navitaire. The difference is that QF took the gloves off quite quickly.

This could set a dangerous precedent, but I do think the move to immediate legal action by QF is a bit ambitious.

It's about keeping options open if a commercial agreement is not made.

Not that QF has to show RR it's calibre of legal eagles in order to ensure it had this option anyway, let alone do this in order to preserve whatever options. The action and intention seem to mismatch.

Not quite sure what you are saying here, sufficing however Qantas has every right to reserve it's rights under the commercial undertakings it has made in good faith.

There will be a lot of background corresponding going on and what we are sensing on the surface will be part of, no doubt, some posturing and positioning as legal options form but one part of commercial resolution tactics.

I understand the TPA has been mentioned hence would indicate a weaker case than I would expect QF to have
 
Well it is a bit of a mess with what seems to be an A,B and C engine version.
QF cost may run out to $250 million seeing the LAX route is a no go until the engines work at the level required.
It is not just the plane fix as there is still no final solution to the problems.

...and pre-emtively strike if the want any hearing to be in Australia, rather than having RR trying to move it to UK.

This was the reason given in the AFR on Monday for taking the action.
The story also said that Merrill lynch had worked out losses of $207 mil.

Wrt the story about qantas not being able to operate profitably to LAX with the Trent 900. I assume that is only part of the claim in the case that thrust is restricted lower than the design thrust that was the basis of qantas buying the engines. Really getting into the deceptive conduct angle.
