So I guess the 10k cap is now implemented.

Maybe for some, but definately not here.

Of the people that had point post this morning...on your transaction record did the points post with a date of 24 Sep ( I have none on that day despite enough spend), or only on dates of 23 Sep and earlier?

Points have posted for both the 23rd and 24th

Dear file51 I regret to inform you that we have retrospectively changed the T&Cs of this frequentflyer promotion and through abuse of the system and people threatening to take legal action we are required to introduce a cap on your bonus points award. However, we cannot decide how much this cap will be or when we will give you further information.

Thank you for your understanding

Sucks to be me then.... :p

That is interesting. As I said I received points this morning from the promtion, but looking at the detailed list there are only the normal 1.5 points awarded on the 24th.

So even though I gained points posted this morning, all dates on my transaction account are for 23rd and earlier.

I had received points for each date prior, but not for the 24th despite having enough transactions.

wanna swap.... suweeet if the points keep coming in however I would expect a correction to occur sooner rather than later.

Congrats on the 1000th post file51

Congrats to everyone else for posting and contibuting - whether beneficially or not (maybe including me) ;)

And finally;

Congrats to Amex for offering (IMO) the promotion of the decade - assuming the status quo of earn remains.

Wow, don't log into AFF for 5 days (before yesterday) and look what happens . I've just finished reading from pages 32 (but had to spread it over 2 days)...

My account seems to have become active from 18th (presumably the date I spoke to Amex CS and had my account changed from 20T/10K points to 10T/5K points). All transactions from (and including) that date seem to be eligible transactions (smallest $15). My first 5K bonus points hit my account on 21st September (together with the 10th transaction). Handy to have some regular payments keeping my transactions ticking over. Have had another 5 transactions since, so I just have to make sure I get another 5 to post by 30th before my tranaction count resets. Would hate to be on 9 :(

Nice to see that the comments have softened between posters ;) ...

There is still so much unknown about what will happen with regard to (any) changes to the T&C's and the issue of bonus points being reversed due to Amex reviewing tranactions tha they regard are not in the spirit of the promotion. All of this talk (whilst healthy debate) is mere postulation until we each hear from Amex.

Overall, I still think Amex will be very happy with the increased use of their cards (and their income). Certainly, as a member since 1989, I continue to be happy with Amex and the rewards they offer me for using their card.

Now if only I could get my 18 month old a supplementary card and get her to use it...but I'm sure she'd only put it in her mouth :D.

OK - another reference point - since my last bonus points were added, I have had 6 further transactions. This gives me a total of 26 transactions since I signed up to the promo.

I have had no Promo points post since 21 Sep when I hit 20 transactions.

At this point one of two things is happening - either bonus points may or may not be being posted in 8-10 weeks or I have been moved onto the lower rate promos 5K/10trans. So my next promo point under this will be in four transactions time - some time n Friday.

If I get a 5K/10 trans bonus at 30 trans or 10k/20 trans bonus at 40 trans then I will give them a call as I signed up for the more profitable promo. If I get no more bonuses once I pass through 30 trans or 40 trans I will then wait 8 weeks to see what happens and request my no limits 5k/5 trans bonuses as advertised by them with the associated terms and conditions.

I will keep monitoring this thread to see what other experiences people have.

Well I think many of us will be awaiting "The Letter".....

I can't think of another occassion where I have awaited mail with such a combined sence of trepidation/fear and hope!!!!

It may be excellent news...or not.....

I guess it is a bit like parents who have had children do HSC/VCE!!!!

It appears that you along with many others have forgotten the lines of T & C that include that they (Amex in this case) can change or withdraw offers at any time. You don't have to like it but it is legitimate. ;)
You and I had a chat about this last weekend in New Zealand and I think it is something that most people have overlooked. Amex can change terms and conditions at any time. So even though this promotion has its own clear terms and conditions it is also covered under the general terms and conditions of the Amex MR program.

If they do it, this will be a PR tragedy!!!

I do not understand why it would be a tragedy. People will continue to use Amex but probably not for smaller transactions. Visa and Mastercard are not great choices. Amex clearly has the best credit card MR program....

really ... ???

It may be for some .. but the realists among us will understand that mistakes are made , and that someone might have underestimated the inventiveness spawned by the utopian image of something for nothing.
Cargo cults lurk everywhere. not just in tpng !!

I'm happy as pig in mud for the 5000 points already logged, and I won't be supporting the ambulance chasers.

I do have some sympathy for whoever in amex is trying to sort out this stuff up , but whatever the outcome I will remain a very happy amex camper.

Are your referring to program abuse? In which case I agree with you. But if Amex change the conditions because they underestimated the costs then that is not a valid basis to retrospectively change conditions.

Not sure what the last sentence refers to but this is not "something for nothing". This was an offer that Amex actually opened to everyone. This is no different to Woolies having buy one get one free promos - this was a promo that the company initiated and they should abide by the T&C they advertised.

Not referring to promotion abuse. It is quite clear that Amex can change terms and conditions at any time which is not restricted to waiting for a promotion period to end before making changes. If that makes some people unhappy then so be it. We accepted these terms and conditions when we signed up for Amex MR.

To throw yet another version out there of my conversation with Amex CS re signing up over the phone for the 'myreward' promo.

She said they've noticed that even when they have signed people up over the phone over the last few days (when the link has not been working) that it seems that the bonus points are not being credited for those people.

She took my phone number and amex details and said someone will phone me back hopefully tommorrow afternoon when the promo is activated again to advise that I've been added successfully to the promo.

When I mentioned that there's a few different promos going around, she said I can only be signed up to the promo I received the letter for.

I'll continue to try the link again tommorrow just in case I don't hear back from them.

Yes, those terms are in the T&Cs of the MR program. That does not mean they are enforceable or not in breach of the TPA.

For example, see the ACCC website which says (can't post the weblink because I don't have more than 10 posts):

It makes no difference whether the business intended to mislead or deceive you—it is how the conduct of the business affected your thoughts and beliefs that matters.
If the overall impression left by an advertisement, promotion, quotation, statement or other representation made by a business creates a misleading impression in your mind—such as to the price, value or the quality of any goods and services—then the conduct is likely to breach the law.
Assume:

  • I got a postcard in the mail;
  • I signed up for the 20/10k promo; and
  • AMEX has capped the points at 10k per month going forward (notwithstanding I may have already received more) but not notified me of this cap.
My reading of the ACCC's comments is that the overall impression of the promotion was that it there was NO LIMIT to the points I could earn. This was on the postcard, on the screenprint when I signed up online and conveyed to me by phone when I clarified with AMEX. To change the NO LIMIT term of the promotion to be 10k, being effectively a LIMIT OF ONE instance of bonus points, is clearly a very different impression to the impression I had when I opted-in to the promotion.

I don't have a problem if AMEX notify me of a cap going forward on the number of bonus points I can earn. This would clearly change my impression/understanding of the terms of the promotion (since the T&Cs says they can change them) and would bring AMEX back into compliance with the TPA.

On a related note, the maximum penalties for a breach of the consumer protection part of the TPA is $10,000,000.

Perhaps not as clear as you think (from a legal perspective anyway).

Here are the relevant American Express T&C

14.2 We reserve the right to suspend or terminate the program at any time we deem appropriate. In such a case, we shall give advance written notice to you.
14.3 We reserve the right to change this agreement at any time with or without notice including, but not limited to (i) fees; (ii) points accrual, conversion and redemption rates; (iii) providers or suppliers of any points, frequent traveller rewards, non-frequent traveller rewards or any product or service obtained hrough the transfer, conversion or redemption of points.

Presumably it is 14.3 that you are referring to. Note that this term does not even attempt to stake out a position that allows AMEX to retrospectively deduct points. Even if there was such a term, it almost certainly would not be enforceable.

Sounds "too good" to be true so it can't be? I am sure Citibank tried their utmost to make this argument stick during the most recent large scale credit card debacle. But they failed, and no ambulance chasers benefited (none of us seem to want that!).

It's probably already been mentioned, but:

The 5000pt/5 transaction promo applies to both Corporate cards and International transactions!

I just got my bonus 5000pts on my Corporate card (which I have responsibility for), and all transactions were from Mexico. :)

Cheers,
- Febs.
