Their advice is that pax *may* be able to claim for delays under the Montreal Convention, but it's a fairly high bar to pass to be able to claim. The same 'protections' of Montreal theoretically apply for international flights out of Australia... I'm not sure if it's ever been successfully used. Otherwise the DOT suggests you go to small claims court.
What is the OP being compensated for, a loss (missed flight connection, hotel accommodation, business meeting etc) or a mere delay (similar to being in road traffic)?
