Hey

My boss just advised I am heading to the US on the 9th of July thru till the 18th/19th July. I have a current US Visa under the visa waiver program, but it expires on 25th July. Will this be an issue? do you need 6 months like passports for travel to the US?

Cheers

Steve

There shouldn't be any issues as the US does not have a 'six months passport validity' requirement for passports issued by certain countries including Australia. As long as your passport is valid for your intended period of stay, you will be fine.

This doesn't actually make sense. If you have a US visa then you don't enter under the visa waiver program.

As opusman said, what you said doesn't make sense.

If you where issued a Visa by going into an embassy / consulate and had an interview, you must have left the US by the date of expiry of the Visa which they issued. You would also need to be careful not to do something which is outside the scope of your Visa (eg work if on tourist visa).

However what I think you have been issued is called an ESTA. That is issued by logging onto the DHS website, answering a few questions and paying your US$10. They are valid for 2 years, but only let you board the aircraft in to travel to the US. They are not a Visa (as they do not guarantee entry, a Visa will guarantee entry provided border officer thinks you are there for the genuine reason as stated by your Visa), and your entry rights will be determine at the border by the CBP officer. If determined that you can stay (unless you've lied or have copies of your resume with you, chances are they will let you stay) they will stamp your passport and that date is the date which you can stay in the US until, they will also write in a code underneath stating the purpose (WT = Tourist aka no working, WB = Business aka you can work provided you are employed by a foreign entity). You can not travel to the US on an expired ESTA, but you can stay in the US on an expired ESTA provided you leave before the date stamped in your passport.

True ... I think it's a bit of tautology ... even then not quite right.

What I belive the OP is trying to state is they have an ESTA that is expiring on the 25th.

Possibly 2 issues:

(1) He talks about passport validity - I'd get that sorted straight away - new passport.

(2) Just get another ESTA - the problem goes away.

(3) Don't tell passport control you are "working". We were travelling with a helper for the kids and the guy wanted to make absolutely sure that she wasn't being paid for the time she was with us in the states.

Why get a new passport if the old one is still valid for travel (and to a country which does not have the 6 month rule)?

Why get another ESTA when the old one is still valid for the entire time the OP is there? (I've reused ESTA's mutliple times, and my current one is getting close to expiry but I had no qualms in using it last month)

No problems with working in the states on the VWP, provided you are doing so as an employee of a foreign company (or US company with a presence in Aust) and it's genuine business travel. I've done it multiple times, explained why I was there honestly and had no problems. What they might be upset about is if you arrive with resumes in your bag and / or are obviously looking for work to support yourself whilst there and / or are coy when explaining what you are doing.
