That is according to defense attorney Stacey Barrett, speaking on behalf of her client, Joseph Schwab.
After being pulled over on 5 August 2015, Schwab was charged by the Solano County district attorney with misdemeanor driving under the influence of a drug.
Almost 18 months later, Schwab is preparing to go to trial. The only evidence the DA has provided of his intoxication is a blood test showing the presence of caffeine.

The Grafton bus crash killed 21 people and injured 22 on the Pacific Highway on the North Coast of New South Wales near Grafton. At some time between 3:50 a.m. and 4:00 a.m. on Friday, 20 October 1989 a southbound semi-trailer truck carrying a load of tinned fruit juice veered onto the wrong side of the road and collided with a Sunliner Express bus travelling the other way.
The Kempsey bus crash occurred in Australia on 22 December 1989 when two full Denning Landseer tourist coaches, each travelling at 100km/h, collided head-on on the Pacific Highway at Clybucca Flat, 12 kilometres (7.5 mi) north of Kempsey, New South Wales. It remains the worst road accident in Australia; 35 people died, including both drivers, and another 41 were injured.
The coroner (Kevin Waller) endorsed the recommendation he made following the Grafton bus crash two months earlier, that the Pacific Highway be upgraded to dual carriageway between Newcastle and the Queensland border. The New South Wales and Commonwealth governments committed to carry out the required work, with an initial promised completion date of 2006. This target never came close to being met; at July 2008, only 267 kilometres (or 39%) of the route had been upgraded to dual carriageway standard, with 87 kilometres of divided road under construction and 325 kilometres of the highway still a single carriageway. As of May 2016, following a sustained upgrade program, 437 kilometres (65%) of the highway between Hexham and the Queensland border was dual carriageway (either at freeway or arterial road standards), with 240 kilometres of single carriageway remaining to be upgraded

Took a little drive yesterday on the Pacific Highway south bound from Brisbane, surprised that almost half the journey is still single lane each way and not dual carriage way.
What surprises most about the upgrade is 2 events that happened in 1989, which was 27 years ago.

Still a bit of a shock to travel on that piece of road, 1989 was the year I finished high school so its a big reminder as the years go past.
Yesterday was a head on crash 32km north of Grafton.
One of the weirdest places was through Ulmarra where there is the 50km speed sign but during school has a 40kms speed sign, on a national highway you have to be crazy.
