What’s the situation these days on who owns my medical records with them?
You own the information. The business owns the record in which the info is kept. No state difference.

Analogy. The post office owns the PO Box in which sits your letter .

You have a right to have that information in that record copied and transferred. This does not mean the record is taken from one practice and sent to another - just the information within. There might be an administrative cost in extracting, copying and transmitting the information within the record.

Patients own the information in their medical record but do not own the medical record itself.

I own the information and the practice owns the means of storing it.

The Prime Minister owns the information about what he said today but the newspaper owns the paper its printed on until they sell it on. Does the Prime Minister have a say on the selling on of his information?

My GP is leaving a corporate practice and setting up on his own. He’s assured me that they’ll be no problem in getting my medical records sent over to him I guess that would be technically via a request by myself not him.
 
Grrr. Supposed to be flying out to Hawaii today but we came down with the most disgusting respiratory infection. Not Covid. Now aiming to depart Sunday. At a cost $$$$. Can't get into a doctors for insurance letters as I'm coughing too much and doctors don't like that.
You've probably thought of it, but can you get a telephone consultation with a doctor? MrsK had used that service a few times when unable to get to the practice as she was coughing so much

Yes, there's been a few court decisions that have reinforced that point. If the GP is part of a corporate practice, the company who employs the doctor is the 'owner' of the record they hold, but you have access to the information about you in that record.

I tried but nothing available today or tomorrow. Anyway, just got a text that we've been upgraded to Business (from PE). That wouldn't have happened today's flight. The flight back is a daytime flight so no drama if that doesn't come through.

That's good at least, pre-departure bubbles in business always makes you feel better - according to MrsK at least

I filled out a form yesterday to get a copy of all my records moved to another practice. I have done is once before when I moved across town

No, just like you don't own the/your info that has scraped by the social media outfits
On the other hand your medical records cant be sold to a third party unless they are taking over the practice - eg a retiring Dr sells his practice to a young gun.

Depends on the exit conditions on his contract with the corporate

All this happy theorising assumes that orgs are honest and responsible.
Many years back our GP , unable to continue as a sole practitioner, sold out to a corp and moved into a large practice.
All his records went to the new org.
After a bit, we found him to have limited availability and access and moved to a new gp close by.
The org ignored all calls pleas and letters asking for the records, said they couldn't find them and other rubbish.
We even offered to pay for them but all to no avail.
IMO.. the matter of patient records, their storage and availability is a blight on the au medical system

Records are meant to be kept for a statutory period. Outside of the statutory period the practice may decide to cull the records.
Assuming the records are within the statutory period, and the practice cant find them, then the best course of action is a regulator like the IPC in NSW
 
Our GP moved from the practice three mins walk away to a suburb about forty mins drive away about three or so years ago
We just submitted a pro forma that requested all medical records to be transferred from one practice to another. No issues. Though handy now in one way MyHealth has a heck of a lot of information. Husband's various hospital admissions and suchlike are all there are wll
