Except there is ZERO way QF could prove intent (of your proclaimed fraud). People buy vouchers all the time for any number of reasons. Just because someone buys a bunch on Feb 1st doesn't follow that their intent has ANYTHING to do with any promotion that may be going on at the time. In the act of buying a voucher it is a valid transaction with the company, for which QF receives money.
One example is to avoid the CC charges, and I do this for all domestic bookings I make or ex-AU. That has NOTHING to do with any promotions and everything to do with saving a few bucks
Again that is an absolutely valid transaction for QF. While they don't overtly advertise this as a benefit to the vouchers, they sell them that way. Is someone going to suggest that buying gift vouchers to avoid CC fees is also some form of fraud? I'd like to see that one go to court
The "action" QF will take against anyone will be either to award DSC or to not. Simples!
I think this discussion is getting a wee bit out of hand.
the key points here are, as discussed, QF's absolutely terrible (and ongoing) wording in promotion terms and the fact, that has been lost, the T&C were CHANGED after the start of the promotion... If there's any legal issues in this whole thing it's surely THAT fact rather than anything to do with vouchers (not suggesting that anyone could or should take this up as a legal thing, but changging terms mid stream? That's not right).
