Would be interested to hear some "legal comment" re any pax who are killed in a terrorist bombing either after they have checked in or waiting to check in (in line)
Would they be covered by carriers liability cover?

Am assuming this is theoretical and it hasn't happened to you recently?

Terrorism is usually excluded from insurance cover.

Liability insurance only kicks in when you are liable for something. How is an airline liable for the actions of someone in its check-in line? I can dream up 'failure to screen properly' arguments for pax and luggage carried on board and maybe even in the lounge - but not in the check-in line. The airline has no control over who chooses to stand in the check-in area.

Maybe you should try arguing that the airport is liable for failing to screen everyone who enters the airport.

Also, sad but true at least under Aust law - from a liability/compensation point of view it is usually cheaper to kill someone than injure them.

Not sure the airline would cover you as they don't usually own the airport, but travel insurance covers you for serious injury or death. Some insurers won't cover you but some will so read the fine print for terrorism before you buy.

If you say were in Brussells you would be covered, it is not known as a terrorism hotspot (yet) but if you say went to Iraq or Yemen you would not be covered even on the same policy.

You can of course get custome policies which will cover it anywhere and include kidnap and ransom but that won't appear on the little card they give you as they don't want the baddies knowing if they call this number they can make $500K.

From what I've heard, some kidnap and ransom insurance, not even the insured know that they have such coverage (again the idea is to not simply tell the kidnappers "call this number for an easy $500K").

Apparently some companies take out such insurance for some of their higher ranking officials without actually telling them they have that insurance. Especially when they send them to places where kidnapping foreigners is not unheard of.

Any decent company will include kidnap and ransom in their travel policy, and any decent company would tell it's employees but perhaps not the level of cover. Someone like BHP Billiton may not carry it, they may self insure.

....Apparently some companies take out such insurance .....

This insurance is to help the company. And it is not cheap as it places a hell of an onus on them and their activities - that is probably it's best impact. But at the end of the day it only helps the company. I have not met a hijack victim that this sort of thing helped.
