I am going to the USA under the visa waiver program for some paid programming contract work which might not be allowed (not completely sure).

To speak freely, I am seriously considering not saying that my visit is for contracting work. This is very risky so I would highly prefer an alternative...

Does anyone know what would happen if I got declined entry to the US? I understand that I would have to buy a ticked back, but what about when I want to go back to the US? And is the punishment going to be worse since I would basically be lying or hiding that my intentions were to work?
 
Getting caught and being held then put on a plane home at your expense is likely to keep you out of the US for quite a few years. The two I have talked to who were deported had not tried to go back so I don't know just how long you would be red carded for under the Visa Waiver Program.
I will ask a former employee about it as it cost him $4k in the process of being returned to Australia.

Honesty is the best policy.

If you are not sure how do make sure you are approved get a migration lawyer and they will be able to advise you with the most appropriate way to achieve the desired end result.

Paid contracting work is definitely not allowed under the VWP.
 
Don't do it.

1/ Being sent back from the border.

2/ Ineligible for future VWP entry.

3/ Ban on any entry for 5/10 years is possible.

All likely outcomes depending on exactly what occurs and under what rule they throw the book at you.

You should apply for the appropriate visa. If denied entry under the Visa Waiver Program, you will no longer be eligible to use that program and will require a visa for any subsequent visits. Get the right visa and travel knowing your entry to the USA will be permitted according to the terms of the visa.

It all depends why or how you think you're going to get caught??? How would they know if you are a genuine tourist or going to work. It would all depend on how long you want to be there. If it was 2 weeks and this was a USA vacation then i can't see a problem. If you were there for a month I could see them asking you a question what you're gonna be doing there.
 
Get a B1 visa - fairly simple apart from the fee and the queue to get an interview (interview itself was quick!)
