TWO female tourists received a savage welcome to Cairns when allegedly attacked by a group of people as they tried to check-in to accommodation early yesterday.

One of the women was allegedly raped.
 
Ugly. Very ugly. Local crime appears to be an increasing problem looking back over the 6+ years I have owned a house in the Cairns area. Many locals feel policing is inadequate.
 
Apparently three have been charged over the incident,let's hope that they (assuming they are found guilty) are given an appropriate custodial sentence.
Must have been terrifying for the victims,hope they receive counselling etc.

Don't bet on it, Nigel. We have a local judge called Sarah Bradley who let several self confessed gang rapists who had attacked a ten year old girl walk out of court with non custodial sentences (ie no jail terms)...(the case was later challenged through the intervetion of Qld Attorney General Kerry Shine)...

Come on Platy, There were racial and cultural issues in that judgement that were incorrectly considered and gave rise to an incorrect judgement. Not to mention some the false academic expert opinion involved.

In this case, they are tourists and the same issues cannot possibly be considered.

Issues were considered in the initial trial by the magistrate mentioned.

Lets just be clear I do not think (and never have thought) they are relevant. The subsequent appeal and actions by the Qld AG have shown that the issues were not relevant.

I also think the suggestion of the issues raised are absolutely disgusting and I really don't want to repeat them in a public forum.

There are some in the legal community who believe that custodial sentences should be avoided if at all possible in cases involving Aboriginal/Indigenous folk. This includes former Justice Eames of the Victorian bench.

The girl was 7 when first gang raped. She came from a Cape community where paedophilia rates are >60%. (I used to date one of the protection officers who worked there).

She was removed and fostered out into a family in Cairns.

Several years later the Qld Gov forced her back to the community against the wishes of her own family.

She was gang raped again at 10 after returning to the community.

In one episode she contracted gonorrhea.

In the other syphilis.

She is traumatised extensively.

The state prosecutor recommended the judge give the self confessed rapists a non custodial sentence. The judge took that as an excuse not to jail them. The judge also suggested that the girl's sexual promiscuity was somehow to blame despite her age.

In the ensuing outcry the Qld Attorney General was eventually forced to have the case examined.

This found against the judge's decision.

The judge remains as a district court judge in Cairns. The state prosecutor was forced to leave his job and works for an Aboriginal Legal resource.

I have lost several friends debating this case locally.

The racial/cultural issues are that the rapists and victim are Aboriginal and people don't seem to have a clue how to tackle a community were child rape is the norm. (That is not supposed to sound anti-Aboriginal, but we are as a community and nation badly letting down those poor kids).

Like I said some in the legal comnuity believe non custodial sentences are the way to go.

Some agree and others don't.

Most people I know in the Cairns area have little faith in Judge Sarah Bradley. The friends I lost were lawyers who seized upon the legal niceties of the case as justification of Bradley's ruling.

My former partner lasted about 6 months in her job as a protection officer. Most only last 3 months before the stress forces them to leave.

(PS. I don't really want to debate this further folks!!!).

Platy I don't think there is any debate. I think I agree totally with what your saying. My only difference is that even Sarah whathername couldn't make the same mistake, due to the differences in the case.

The reporting I read suggest that Bradley accepted the argument that the girl consented. Which seems to be a complete failure in interpreting the law. There is no legal nicety in the fact that under 16 years no one is legally capable of consenting.

Sounds like your better off without these formers friends.

Lets hope that all low life scum get what they deserve.

There is no way that they will get all they deserve because available punishments have gone backwards over the last few centuries.

Wonder how they would react to a touch-up with the red hot tongs.

I'm not advocating that muscle be torn or privvy parts be seared but with modern wound infection control, a sanction such as this could be applied in public or broadcast on television and would mean that the sight of smoke pouring from the offender's flesh along with the screams be a deterrent to other "low life scum".

Not having to have a custodial sentence would mean that the net cost to the community would be less.

Probably after a short hospitalisation, an offender could be released with the slate wiped clean.

Yes indeed. A few weeks ago I witnessed a road accident. We have a problem with hoons in my suburb. This hoon floors it out of a roundabout in a 60 zone, accerelates with the custom screech of burning rubber slap bang into the rear of another car without even pausing to apply the brakes.

I am a witness. I check everyone is OK, no ambo required, and go home and write up a statement with the incident still fresh.

I ring the local pig sty. Offer my statement. They promise to ring back. But never do. Even though operation something or other is supposedly operational to catch the loony ute brigade.

The local pigs drive up and down our esplanade in their pretty cars but don't have the balls to get out and challenge anyone on the edge of the law.

Pigs on the public purse and in the meantime the violence escalates.

When they do pull a real psycho, the local judge lets them off.

No wonder movies like Death Wish, Spiderman, Batman etc resonate!!!!!

Replay the movie Sin City on DVD...ah...

I too worry about them it brings me to tears. And by comparison we have a teacher in Victoria put away for 2 or 3 years for sleeping with her 15 or 16 year old student. On a comparative scale I know which is the far worse crime.

Hate and non forgiveness breeds more hate. Whilst I am not suggesting too easy a punishment for this crime as it is very serious, positive reinforcement works a lot better than negative reinforcement.

Punishing offenders in a cruel way just creates more hate inside them and causes them to become worse and more selfish.

The best way to change people in my opinion is with love and forgiveness. Yes appropriate steps need to be taken and some punishment needs to be given, but often the offender offended in the first place because of a lack of love and care shown towards them.

Totally unbelievable! I hope the attackers are sent away for a long time....
