DPP v Sant: false air traffic control communications

This may be of interest to some AFFers (DPP v Sant, Victorian County Court, 2 October 2019):


One interesting fact is that the judge mentions how the flow of aircraft in Oz can be established by ATC up to 90 minutes prior to each arriving. This was in reference to how an aircraft that did a 'go around' as a result of this imposter pretending to issue that instruction was then out of sequence (and other inbounds were adversely affected).

One of our aviators, many months or years back, referred to arriving aircraft as being in a sort of game of chess. I've always remembered that comment. Mr Sant's actions, however, were like the disruption caused to Gotham City by The Joker (except unfortunately it could have, in a worst case, resulted in loss of life.)

I am in two minds as to whether this young offender ought have been jailed. He served 31 days on remand.

On the one hand, he's young, silly and has autism.

On the other, since he wasn't jailed after sentencing, does it send a message to others that they'll be treated leniently if they 'skylark' and make what could be incredibly dangerous hoax calls to flight crew? As occurred with one of these false calls, a pilot may immediately act on the 'instruction' before the Tower can cut in and inform the flight crew to not adhere to that 'false call.'

As should surprise no one with even cursory knowledge of Victoria's "justice" system, many of the judges are very left wing.
