I must say I am surprised that while there is so much coverage about his deportation, very little media coverage has went into exactly how much power the minister has to deport non-citizens (even PRs) and how people get locked in those hotels for months while waiting for their appeal through the courts, the Sunday session by Federal court in this case is the exception, not the norm.

Are you really surprised though?

All this talk of the possibility of asking for the 3 year banned to be waived next year,

Do we really think the need for foreign passport holders to be vaccinated to enter Australia will be dropped in the next 12 months?

I think he’s in for a long wait to return unless he rolls up his sleeve

I must say I am surprised at the sudden attention on this law and that people did not know of it's existence...

So there are several pictures of him in the Marhaba lounge at Melbourne this evening (including posted above).

I'm confused I thought there was a vaccine requirement that to access venues (which includes airline lounges) in Victoria you had to be vaccinated or had a *legit* exemption.
Having spent a couple of hours in the MEL Marhaba when I was hoping for QF F, this may have rubbed salt into wound.

View OK
Seats OK
Food poor to OK
Drinks (esp wine) poor
Glasses plastic
Did have meat pie station though (presumably with gluten)

Perhaps the Vic panel was to also assist players get an immigration individual exemption
Now why would that be?.
Chairman Dan has said “no jab no play” and then said visas are for the Federal Gevt to administer. Given that why would the Vic Govt then assist in an exemption?

The Vics saying no one told them that the Feds had a No Vax no entry?. I find that hard to believe.

Nope the Vics and TA were up to their necks in it while in public Dan saying another thing.
I remember the previous Aus open when tennis was allowed but recreational tennis was not allowed in suburban Victoria.

On the other hand doesn’t this put ScoMo in the same “tough border policies” basket as Anna, Dan, and Mark?

Yep

All valid points

Covid plus Politics plus Sport plus $$$$$$$
= Merde
(all combinations of the above - if the constant is politics - arrive at the same conclusion)

Occasionally …. very occasionally … we get the ringside seat to watch it all - as we did here - and get to see all the players covered in it (and happily NoVax gone - although he did get into the lounge at the airport)

Once the Full Federal Court has issued written reasons, Novax might still seek special leave to appeal to the High Court even though it's too late for AO 2022. There are 2 reasons he might try that. One to try to clear the way for him to return for AO 2023. The other reason, if he gets special leave and then gets a win in the High Court, might be to bring a compensation claim against the govt for financial losses which might include the loss of opportunity to earn AO prizemoney, and sponsorship.

That seems like throwing money down the drain. Paying lawyers to file special leave with no guarantee that the HC would take the case. Even if special leave is granted, the low likelihood of the decision being overturned and being ordered to pay costs.

Plus, at this point, he should just read the room. Might be looked upon favourably when he applies to enter next year.

Read this morning that Tsitsipas, Zverev and Medvedev were not vaccinated until it became clear that to play the Aus Open they would need to be vaccinated. I think the percentage of such players went from around 50% to 97%. I hope that TA is more closely questioned on their role on any assurances they might have given Djokovic, and actual advice they gave him, so that he could come here without vaccination.

Some media are reporting players' comments indicating Djokovic was happy to stay home and not play at some point. Maybe between 10 Dec (deadline to make tournament exemption application) and 18 Dec - Tennis Aust was talking to Djokovic about the situation and ultimately once Djokovic was infected Djokovic decided to try (or was convinced by Tennis Aust to try).

No doubt Tennis Australia is very complicit in the whole situation.

This. TA seemed to believe they were somehow above Australian laws. They had no authority to hand out exemptions, they had no authority to issue Visas and they had no authority to determine who could enter the country to play in their tournament. All facts that they seem to have conveniently ignored.

Lots of talk about the three-year ban that is generally applied to Visa cancellation and deportation. That would actually mean he missed AO2022, AO2023, AO2024 and AO2025 - four years of tournaments, as he would not be able to apply for a visa for entry before 16th January 2025 and that would be too late to participate in AO2025, assuming similar scheduling of future events.

I expect that by AO2026 he may no longer be quite so competitive on the court. But it does give him plenty of time to research the science of vaccination.

Lets hope the storm departs the tea cup long before 2025.

Would be great to also see some leadership from international tennis federation. No jab no play for all tournaments would ensure that this never happens again
Agreed - they'd only need the Professional Tennis Players Association (PTPA) to sign up, and it should be a go! Now, who was it that created the PTPA again?... :p

A new record for hyperbole from Novak's Dad trying to compare this decision to an assassination, totally laughable.

From ABC:

Srdjan Djokovic took to social media to blast the Federal Court's ruling to uphold the government's decision to cancel his son's visa.

"The attempt to assassinate the best athlete in the world has ended, 50 bullets in Novak's chest," a post to his Instagram said.
