Hi Guys,

Just wanted to say great forum with so much great advice and information. I have done a search and couldn't find any information that was closely related to what I'm in at the moment.

So to start off I have decided to apply for a work visa to Canada. I work for Apple Computers here in West Australia and I will be getting a transfer to a Canadian store if everything works out. I'm doing the application via International Experience Canada.

I have already obtained my Conditional Letter of Acceptance, and then proceeded to continue the application process via the MyCIC portal. I have sent of my application with all the supporting documents needed EXCLUDING my police clearance as I was still waiting for it to arrive and my acceptance letter was about to expire.

Now I have received my police clearance and on the check my charge for reckless driving (Hoon Law) is listed which happen this year (2014). It is my 1st ever traffic offence and I have no prior criminal and traffic offensives. I have paid the fine in full and had my license suspend for 6 months as per the 1st offence punishment.

I wanted to know if this is going to hinder me from obtaining my Work Visa for Canada. My application is still in "open" status and they have yet to ask for my police clearance.

Should I contact the Canadian Embassy and seek advice from them? Should I try and appeal this with the courts?

Any information will be greatly appreciated!

Seems to me you have little choice but to let the application take its course. I'm thinking an appeal would take some time and presumably by that time your Work Permit application would probably have expired. But if that doesn't sound right to you, by all means appeal.

No harm in contacting the Canadian Embassy, but I doubt they'll give you definitive advice. My experience with Canadian authorities (never actually applied, but have enquired about Work Permit) is that every case is assessed on its merits.

If you are able to garner some character references to counter the hoon thing, that may help.

There are also a couple of threads here about getting a US visa with a criminal record - different from your case on several counts, but maybe worth browsing; may give you some tips. You can get to Canada direct, but at some stage you will probably want to enter the US, so wouldn't be wasted in any case.

Thanks for the advice RooFlyer really appreciate it. I'll try and get a reference from my line manager and also a professional reference. I'll send that along with the police clearance when they ask for it. Will also definitely look at the other threads for the US as I would like to visit at some time if I do make it to Canada.

I got my application for the visa refused because of the charge. Looks like no Canada for me :(
 
It is sometimes worthwhile for anyone in this situation to apply for additional police clearance's in a few other states that you do not and have not lived in. (this obviously needs to be done before submitting a clearance with something on it)
 
The police clearance I sent off to them was a Federal one, which covers all states in Australia. I have no chargers before getting this, I thought that this being my 1st charge and being of minimal severity (no jail time served, just a fine) that it would not be taken so serious. But I guess it all depends on the case officer handling the application? Oh well, maybe another time. Work isn't going to be happy! haha
 
Police clearances used for the pr / work Visa applications I have experience with are applied for at your local station - I am unsure if they are a state or federal clearance but they have been suitable for many dozens of work Visas.

CIC only accept AFP Certificate or they refuse to process the application, so I've been told.
 
Curious to see how you got along? Was it approved?
Im going through the sane process at present but it's just for holiday but I have a criminal history from 20 years ago.
For people looking into it. Be careful the checklist online seems to be different and I was asked for a AFP police check as opposed to my national one and I was also asked for my traffic history since turning 18. I couldn't find reference to that when I first started the process.

Canada is very touchy about drink driving convictions and will deny admission based upon an old conviction.
 
So all the information about a conviction being older than 10 years you can be automatically deemed `rehabilitated` is incorrect then? I fortunately dont have a DUI, but there website should state that DUI`s make you unadmissable for ever. Thanks for your reply.
