Age limits on family who die for travel insurance trip cancellation

Interesting letter, I have not seen this before stipulated in a policy :

Insurance dismay
Much to our dismay, we were not covered by insurance due to our mother's age of 97. My insurer (Qantas/QBE) said there was no coverage if the deceased is older than 80, and my brother's insurer (Webjet) stiplated 85. We took out the top cover but we lost thousands of dollars.

Letters: I will tolerate Tiger no more
 
Surely they’re liable if they took the money?? They should be able to check the age of the person being insured, and say no if they’re not going to insure them.

Luckily I don’t have to worry about this for a while! :p

Its the ages of the immediate family that are the issue, not the insured as far as I can tell, seems to be a big out clause for them!
 
It all comes down t whether age limit for the passing of a family member was clearly disclosed in the terms and conditions agreed by the travellers when purchasing the travel insurance. As with all insurance products, its the purchaser's responsibility to ensure the product meets their needs, and its the insurer's responsibility to ensure all the information the purchaser needs in order to make that determination is made available to them.
 
I agree is buyer beware, and it is clearly stated in the PDS for the QF product:

A loss where the reason for the claim is the injury, illness or death of a person who is not a member of your travelling party and is 80 years of age or over at the time the Certificate of Insurance is issued.
