AUS PR Pending, US Visa Once Rejected

Hi all,

My family and I have been living in Australia for almost 3 years now. We were originally on a 457 but have now submitted a PR application. The PR application has finally moved into an assessment stage.

I am starting to worry a bit though because almost 10 years ago I paid a small fine (~$44) for marijuan_ possession and misdemeanour theft. As a result of the weed, I was denied tourist entry to the USA about 9 years ago.

I have disclosed all of this to Aussie immigration on both the 457 and PR application but since I don't have access to the US visa application that I submitted 10 years ago, I'm unsure if there are perhaps small details that differ i.e times of events, quantity etc.

Should I be concerned? I know the two countries share visa info but unsure what details are shared and if the department would reject based on small mismatches in the stories.

A lot of risk for us, my wife is pregnant, back home my company no longer has offices, we've sold our house and don't have medical aid there so holding thumbs it all comes together and we're not sent packing.

Any advice would be well received.

My experience so far with immigration agents is that they'll assist up until they have your money but then radio silence until a decision is made
 
You'd be much better off on one of the many Australian immigration forums. The thing about asking an Australian travel forum about this is that while many are well versed in travel processes out of Australia, not as many would be well versed on immigration into Australia.

I certainly would have fallen into that category, but while living overseas for almost a decade I met and married my wife, and we recently moved back to Australia together. Having now experienced the system I realise how little I knew about the subject at all being born here and not having dealt with it.

But if there is one thing that is clear to me from reading the forums over the past few years we've been dealing with immigration process (thankfully now done), I learned that the one thing that is penalised ahead of anything else is any sort of falsification or omission of information. In that regard it certainly seems to me that you've done exactly what they would have expected of you.

Outside of that, good luck and once again I recommend going to the dedicated immigration forums, they often have migration agents who frequent the forums and will often answer short questions or assess how complex your situation might be.

Just tell the truth on your Aussie PR application. That's all you can do. If for some reason you gave incorrect details on your US visa application, you shouldn't look to replicate those incorrect details now. Getting it wrong twice won't help you.

Will the US share your visa application frmo ten years ago with Au authorities? I'd say the chances of that would be almost zero.

Thanks for the feedback. I was honest on both applications but the US visa was such a long time ago. Any way, i'll let you know how we go - hoping for the best, obviously.
