Which airline pays my lost baggage claim in EU?

I purchased Qatar airways flights using my Qantas points from CGK>DOH>DUB. Due to delay missed the connection so Qatar gave me a flight to ATH and then Aegean airlines to DUB, and never got my checked bag (golf clubs). Reported to Swissotel at the airport.

So who do i lodge my emergency purchases claims with ( and subsequantially loss claim), is it Qantas, Qatar or Aegean?

FWIW i have since confirmed with Qatar my bag was on the flight with me into DUB, but technically I am not supposed to know that as i have had no response to the missing bag claim so far ( 12 days). This bothers me, they could claim its my fault for not collecting it, could they?

Another thing.. in have been studying the EU rules. Seems that airlines is required to declare bags lost after 21 days and pay compensation, capped at about Euro 1400. However Aegeans helpful website says they do that after 45 days for peasant class travellers. Would welcome anyones wise input on that.
 
My understanding is that claims for delay or loss are against the last airline that carried you. The are supposed to sort it out amongst themselves as to who did what and where the loss or delay occurred.
 
Update, no update.
is now 30 days since DUB lost my bag and I have heard nothing.

Also no reply to my emergency expenses claim, submitted 18 days ago.

How about claiming it on your travel insurance rather? Will most likely be quicker and more reliable in any case...

You might need a letter for insurance saying the bag is indeed lost? Which if you can get it, is an admission by the airline… and the airline should then pay!

Cant. Must claim on airline first. One of the specific items on the insurance claim form is confirmation of how much the airline has paid in compensation.

Yes. The lost bag claim will be the evidence of that, which is also updated online.

FYI Article 17 of the Montreal Convention says an airline must pay compensation up to ~AUD2450, if my bag is not returneed to me within 21 day, so its somewhat comforting that I will eventuallu get that payout regardless, on top of the emergency expenses.

Aegean airlines outline their process for this on their website, so I am not worried about whether they will pay, its just a matter of when!
 
Day 56, dublin airport swissport calls at midnight to ask me where i want my bag sent, gives no ETA just that Brisbane will call me when they get it. thats the first response to the lost bag report. 2 days later still no update in worldtracer, which still says tracing continues.

swissport never replied to 2 emails sent on day 14 and day 45. They dont answer the phone nor respond to the voicemail messages

Aegean has not responded yet to my expenses claim submitted day 14, and compensation claim on day 45.
 
Day 62 - got my bag back from BNE airport, had to go collect it myself. It came on Emirates which had no relationship with the airline or baggage services so they said if i wanted it couriered, contact original airline. Anyhow customs wouldnt release it as bag had a lock, and they wanted to look inside - but the baggage services guy organised this and toook about 20 mins. (so there goes my idea of a cunning plan to smuggle stuff into AU). I did feel like complaining the bag hadnt been opened before it left australia, but ... hey:) Baggage services was very casual about handing over my bag, didnt check my name, or ask for paperwork, but i guess several factors made it obvious i was genuine. Rightfully i can claim travel expenses from insurance to collect my bag from BNE, but i wont - see below.


Was as excited as a kid getting a new bike for christmas as i opened it up and got my golf clubs and all my gear back. but then it settled in, such a let down as its just all my old cough.:oops:

As for claims for Emergency expenses
Aegean was really slow in responding- 4 weeks each time. They kept asking for the receipts, i kept saying I uploaded them on their website and resent again. after doing this two times, i worked out that she only say the 1st page of a 15 page PDF file. Once that was sorted they paid out every cent i claimed, around $750, including items that I never expected they would, like Golf club hire, golf glove and balls, these being consumables.

Then a lucky bonus. Because Aegean took so long to reply, i decided to submit my claim to my travel insurer to get the ball rolling, Complimentary Covermore via Commbank credit card. a question on the form asks "have you received compensation from the airline" and i honestly answered NO (other option was yes). I fully expected as per the Terms of insurance that they only pay after getting proof of compensation from the airline, and thus pay any shortfall that they would request this later. However after 2 weeks they paid me $500 no questions asked. Do i feel guilty - partly, but there were other expenses and inconveniences after i got home that make it close to even.

My experience with insurers is; provided the 'event' is verifiable and you have receipts they pay up without fuss.

Finally, I have lodged a claim on Aegean based on Article 17 of the Montreal Convention which stipulates that if a bag is not returned within 21 days its declared lost and passenger is entitled to compensation of 1288 SDR's - roughly $2500. After 4 months their first reply is "we already paid you $750", so they are being obviously stupid or clever. After one more month they now ask for receipts for the contents - so thats progress.


footnote: my missing bag report filed by Dublin baggage services at WorldTracer still shows my bag as missing.

In Conclusion: Aegean Airlines paid me compensation of Euro 900 according to Montreal Convention, significantly short of the approx EURO 1600 (1288 SDR's), assessed according to them 'based on class of ticket, weight of luggage'. I guess the law says "Up To ..." so I accepted their offer. I did reach out to one of those websites that fight the airlines on our behalf and they never replied.

Its pretty sad that Aegean had to pay up due to the incompetence of Swissport baggage services, who made no attempt to look for my bag on Arrival in DUB, despite the fact that it was later revealed my bag did arrive with me on my flight. On an earlier journey the same bag went missing on arrival in CGK, the Swissport staff searched for 30 mins and found it out the back somewhere.

Plus: Airline also compensated me $750 in full for expenses, and insurance paid up $500 for expenses (see above)
and I got all my luggage back.

What i have learned:
- get a luggage tracker
- keep receipts for *everything*
- make an inventory of luggage
- if providing insurers and airlines with receipts, they pay up without questions.
- pack carry on wisely in case of lost luggage.

Highlight of the whole saga was walking 1km to a carpark Coin Laundry machine in my Pyjamas on day 1 near DUB airport.
