COVID-19 and Tennis

We seem to have some brilliant legal minds (posting opinions upthread), who have until now gone totally undetected. 😉

Few legal minds on some socials claim that if it’s transferred to the Federal Courts his chances are very slim.

His lawyers were certainly keen to keep the case from being transferred to the Federal Court

Good morning everyone
It looks like I feel asleep in intermission
Now I awake to find…..
(a) except for time with his lawyers he’s back in detention
(b) off to the Federal Court Sunday
I‘d be interested in understanding b from legal-AFF’s
Getting closer to using my tickets hopefully…

The court order from Friday night is here:

Things I was interested by:

The govt now has an SC (although Novax still has 2, not that it's a numbers game), and both sides now have 4 barristers each (plus solicitors).

The hearing will be in the Federal Court, which is a rung higher than the Federal Circuit and Family Court, but it isn't entirely clear whether it will be heard there by a single judge or by a Full Court which is usually 3 judges

Novax must file his written submission by noon Saturday

The govt can file its written response by 10pm Saturday

Novax agrees that his lawyers' oral submissions at the hearing will be limited to an hour

The parties want a hearing on Sunday.

I will have a look to see if i can find any Federal Court confirmation about the hearing.

thanks @Anna - will it be a streamable event as the others were ?

Dunno sorry. I can't find that the Federal Court has agreed yet to take the matter on, let alone made any hearing arrangements. I assume they will take it on, but it would be hilarious if they were too lofty and important to give up their weekend for something as petty as a sporting contest 😜

As from 8am Vic time Novax is technically back in immigration detention, with permission to be under Border Force supervision with his lawyers at certain agreed places at certain times (those agreed places not necessarily being disclosed to the public).

So it’s not even guaranteed it’s on Sunday ?

Wonder if he’s allowed to speak at an anti vaxxer rally 😂

Polls suggest greater than 90% Australians want Novax out of the country, the government wants Novax out of the country, reports of tennis players many whom vaccinated to be able to play in Australia want him gone. Novax must have a thick skin and exaggerated opinion of his popularity. Psychopathic traits.

I think he has damaged his brand immeasurably and he just does not see it. He will always be remembered for this fiasco over his many achievements, certainly the former will get a mention whenever the latter is reported. It is a situation of his own making.

That fella Tiley at the TA must consider his position within the organisation.

That must be the first time ever the Federal Court has used social media instead of the usual legal channels to announce a hearing 😂😂

I still can't find if there's a Federal Court file yet.

The Govt will get the blame as usual.

Yes. Not to mention the affected players in his half of the draw who have no idea who they should be preparing to play on Monday or Tuesday and beyond. It's not just that Rublev moves up, it's then that someone else moves up to replace Rublev's spot and someone else then moves up to that spot etc etc, ending with some player who failed to qualify being allowed in at the last moment to take the bottom spot - meaning that person can't even go home to get on with their life and their preparation for their next attempt. Djokovic is being incredibly selfish, and he could stop all this any time he chooses.

Not only the Australian court of public opinion has swung against Novax but quite a few OS reports now are against him staying. He really has damaged his brand.
