Bankwest Transaction account [General Discussion]

Well for those who got in early, we can all be thankful this is only showing up on Ozbargain now. This will surely kill this for anybody still running small transactions on this account.
It was good while it lasted. I guess when the OzBargain folk get onto the Avis Black thing, that will be the end of that as well.

So have been a long time reader of these forums but today registered to share my situation.

I had my account closed by bankwest some months ago for breach of t and c's related to my transaction history etc

Yesterday 23/12 some 4 months later I got an email from QFF advising that my account had been in breach of the terms and conditions and that several transactions resulting in points were under investigation. 2 hours... yes two hours later they removed 166k points from
My account (the exact amount I had earned as a bankwest customer). I was like ok fair enough.. but then maybe 45 minutes later my qff account was closed and all points lost. I rang them and was told my account had been in severe breach of the terms and as such I was no longer eligible to hold an account. (They confirmed it was all bankwest transaction related when I spoke with them on the phone)

Just thought I would share my experience.

This post is about to get a lot more interesting if they start shutting down the QFF accounts of people who have been exploiting loopholes with all points (regardless of source) being lost. Time to get the popcorn.

This is very concerning. Did you ask Qantas what T&Cs of their program have been allegedly breached?

That didn't answer the question...

Given Qantas are acting against their own T&Cs (and we could even be talking about a massive privacy breach by a major bank) that has caused a material loss for a consumer, then legal action is entirely appropriate.

How is it a privacy breach? What part has been broken. Given that the OP had his account closed by BW, the show cause isn't a factor as the "guilt" has been proven. Therefore the 21 days may not apply

It seems likely that bankwest passed on details of transactions to a third party (i.e. Qantas).

The accounts were not closed by bankwest because of a breach. They were closed simply because bankwest has the right to do so. Had bankwest said "we are closing this account because of breach xx_" then it may be different, however they did not.

For Qantas to have decided "guilt" then Bankwest have clearly handed over a lot of information regarding the individuals account.

I still cannot see any breach of Qantas T&Cs (not Bankwests for that matter).

Again where is the breach? I am sure in the T&C of the BW it says it can disclose information. Therefore there would be no breach.

Or were they closed because of misuse of the accounts. Which also breaches the QF T&C..

You've clearly made up your mind on this so there's no point debating it.

However quite simply, bankwest closed the accounts not because of a breach (because there wasn't one) but because they wanted to.

If bankwest said months ago "we are closing your accounts because of breach xx_" then we'd be in a different position, however they simply didn't.

This was a poorly executed product on the part of bankwest. That's as simple as it is. Both NAB and American Express have made the same mistake in the past.

I'm surprised Qantas is putting themselves in the middle of this as saying "we are closing your account because a third party tells us you did something that they don't like" is weak, to say the least.

I don't know that there is much evidence that it happened this way. Lots of Bankwest accounts closed; and one Qantas account. I'd say something else is going on, but may need that lawyer to get to the bottom of it!

Handing over specific transaction details to a third party rewards provider without any communication whatsoever with the account holder is a privacy breach, regardless of what little clauses they have regarding disclosure.

People didn't fight it because bankwest were within their rights to close accounts with no grounds. Just as people were entitled to use the account to their full benefit. Nothing was "milked", it was simply used fully within the terms even up to an unpublished daily limit.
