I was just reading about a recent claim in Queensland where a passenger on a EY flight from SYD to AUH after sitting next to someone who took over the space in his seat.
https://www.theguardian.com/business/2015/jul/30/traveller-sues-etihad-back-injury-obese-passenger.

I remember a few years ago there was an Italian man who took EK to court after sitting next to an obese passenger who also took up neighbouring seat space. I can find the original article
Italian lawyer sues Emirates airline for having to sit next to obese man for nine hours | The Independent

but I cannot see any follow up. Was the case resolved? Settled out of court?

Has anyone heard of the final outcomes of any case where a passenger has taken the airline to court for not being able to use their own seat "space"?
PS this is not intended to be an attack on larger passengers.

No follow up that I can find or have heard about.

But, it is not unheard of for these types of cases to take a long time to be resolved. And/or be settled beforehand. With a subsequent confidentiality clause.

Strongly suspect it would have settled before Court. No airline would want to be the precedent case for liability for compensation in these circumstances.
