Airline Settlements

Haha if its not economically
Given the number of Settlement Class Members, it may not be economically practical to distribute money until additional settlements or judgments are achieved.

I think @drron and @Lynda2475 while not "in" the money are definitely "on" the money wrt potential payouts.
The fees from cashing the cheque would wipe out the payout.

Even if you can cash it.We got a cheque refund from AA and no one here would cash it.Was a small amount .This one would be even less.

And knowing how backward baking is in the US it would be a cheque!

I once booked two kayak trips in Chicago online and paid by credit card, however due to adverse weather one was cancelled. Instead of refunding the US$50 to my credit card (where i may have lost 3% foreign transaction fee) they snail mailed me a US$ cheque which cost AU$25 to deposit here!

Would be one that might go into a frame on a wall

yes it would definitely be a cheque because it is a lot harder to get the electronic funds transfer details.

And because for some reason in the US some banks charge more for direct deposit than a cheque.

Hopefully if I am awarded something there is an option for unclaimed monies to go to a decent charity. The suit is puzzling given how cheap SouthWest flights are, it only cost me US$49 to fly SFO-LAS return, one could never fly SYD-MEL return including checked baggage for that price.

John, let's be honest, it's just the lawyers who will benefit - they have to put the charities in there for the word count.
Of course you're right. The point of this class action is to make money for some lawyers. Is there another useful point I am missing?

Id still like to understand how they were able to get my personal details without my consent.

Because the airline is required to notify you that you are a class member.

And it is a court ordered process.

Except neither SouthWest nor Delta nor AA have contacted me, only the law firm. So im still not convinced my privacy rights havent been contravened - when buying a ticket i dont recall reading a term that says my contact details could be passed to lawyers inventing work for themselves.

In Aus law firms advertise to solicit participants in any class action, they cant demad a company hand over customer records on a fishing expedition to find complainants.

Actually - usually there is an advertisement to seek the class representatives i.e. to find the minimum of 7 people who has an action against the same party. Once they have these originating members and meet the other threshold requirements then you are automatically in the class. This is because Australia operates an Opt Out model too i.e. you have to give written notice that you wish to be excluded from the class.

And no your privacy rights have not been contravened - as I pointed out, there is an exception to the privacy legislation and that is when there is a court order. And this is what happens - the Court orders the sharing of the class members details so the Opt Out correspondence can be issued.

So there is no fishing expedition to find complainants - the law firm advertises for the class representatives, they get the numbers and form the class, have it certified and then everyone else 'affected' becomes a class member unless they opt out.

There is plenty of material online to read up about class actions if you are so minded.
