State border closures illegal under the highest law in the country?

Certainly. It shouldn't need saying, but there's a difference between a state acting unilaterally, shutting everyone out vs. acting in ongoing discussion and co-operation with bordering state and federal govt. The more directed 'ring fencing' (to use a term) is a more suited strategy to dealing...

State border closures illegal under the highest law in the country?

Update: Travel Essence and others, and Palmer/Mineralogy vs. QLD have suspended their action as the border is set to open next Friday. They will recommence if the border doesn't open. Mineralogy vs. WA continues, before the Federal Court July 8.

VA no longer issuing credits to travelbank (or anywhere else)

This is not quite the topic of this thread, but does anyone know of any cases where Conditional Travel Credits have been successfully applied to flights *not* in the name of the passenger as originally booked? I take it as read that they're only meant to be applied against flights taken by the...

State border closures illegal under the highest law in the country?

Following today’s National Cabinet meeting it was agreed that everyone agreed in May to the detailed and specific three phase plan of reopening Australia, including ‘all interstate travel’ to be allowed in ‘phase three’. As agreed, each state started each phase at different times, and each...

State border closures illegal under the highest law in the country?

Agree strongly - it's been a bit inconsistent from the QLD premier and CMO. They're on a hiding to nothing.

State border closures illegal under the highest law in the country?

Thanks for this Anna, I've been searching for exactly this - quality/official information. I have no confidence in the media to report on anything. I'd rather have a crack at reading and understanding the material myself with a small chance I'll actually understand it correctly than rely on a...

State border closures illegal under the highest law in the country?

Given the false positive rate, I found it suspicious that in the 18,500 tests in WA of asymptomatic people, zero positives returned. I would have expected a couple of false positives which required re-testing (and quarantine until confirmed clear). As expected from expanded community testing...

State border closures illegal under the highest law in the country?

Does anyone want to guess what factor it is that leads to the borders coming down? I can't see how we get there from here with everything now aligned the way it is. I suspect it could be the High Court.

State border closures illegal under the highest law in the country?

I had a hunch this was going to tug at the fabric of federation about 2 months ago, but dismissed it as silly. Now I'm not so sure. I don't see why anyone in WA should accept anyone entering from interstate (except for those directly affected by the issue, which are surely a minority). If the...

State border closures illegal under the highest law in the country?

The WA premier has answered my question; Total de-restriction in WA from 18 July. Why should anyone there be persuaded that opening the border is a good idea before COVID is eliminated in every other state in the country?

State border closures illegal under the highest law in the country?

Key difference - a resident of QLD may leave and return unhindered (unless returning from a 'hotspot', like Melb was just declared this morning). A resident of WA may not return without exemption, and they're actually pretty stingy with them. The reason WA does not offer similar treatment to WA...

State border closures illegal under the highest law in the country?

So the aim would be periods like 4 June to 11 June - but in perpetuity. Fine, sounds good. But meaningless without a national strategy. I don't see why states which have it eliminated don't just totally de-restrict now ah la NZ on the basis the borders can be kept up with impunity.

State border closures illegal under the highest law in the country?

Bang on. There was always necessarily going to be some disparity between state performances - what were the odds on each state having around the same number of cases around the same time? Today it's Vic. It used to be NSW. Tomorrow, who knows? The federal govt sat on it's hands while the states...

State border closures illegal under the highest law in the country?

https://www.abc.net.au/news/2020-06-17/wa-government-in-advanced-discussions-to-reopen-border/12365262 WA give the first official sign they're seriously looking at setting a date. It's become farcical all this. I'd still love to see the limits of state power tested in the High Court, but the...

State border closures illegal under the highest law in the country?

March 22; borders probably necessary https://theconversation.com/states-are-shutting-their-borders-to-stop-coronavirus-is-that-actually-allowed-134354 May 21; getting to a point where its at least arguable, difficult because facts change over time. There will come a point where the facts don't...

State border closures illegal under the highest law in the country?

I have other posts to add to - but I find myself wondering right now more than anything - what would happen if a state like the NT declared 'elimination' like NZ (46 days since last case, and zero community transmission ever) totally derestricted internally (ah lah NZ?) but kept the borders up...

State border closures illegal under the highest law in the country?

Anne Twomey agrees with you. Summary of her latest conversation with media; - The border closures were very likely defensible when they were first implemented - As Australia continues to succeed in containing/controlling the virus spread, the situation will certainly move to a point where the...
