The Emirates airline will "quietly" seek federal government approval to fly between Australia and the US, a senior airline official has told a trade magazine.
I wonder how they plan to meet the criteria that the operating airline must be either an Australian or US registered company? Until they can meet that criteria, they will be in the same boat as SQ and any others also wishing to fly the route.

But if they set up an Australian company to operate the flights (e.g. Emirates Australia), then there would be little to stop them doing it. Just like SQ could do it if they started Singapore Airlines Australia to operate the flights.

but of course an Australian company will be subjected to Australian company operating laws including labour conditions, company tax etc, which may make it less attractive for them to do so.

But does the Au company have to be majority Aussie owned (51%) as Virgin now is ?

I am not sure about ownership requirements. But certainly must be a company registered in either Australia, New Zealand, USA or Canada under the current requirements. Others may know more about ownership requirements.

Basically they can't just set up a local shelf company - there are ownership and control provisions. Just as an aside Virigin Blue has had a higher proportion of shares Australian owned than Qantas for a few years now, although haven't looked since Toll gave its VB shares to Toll shareholderd.
