CONDITIONS OF ENTRY

  1. Information on how to enter and information on prizes forms part of these Conditions of Entry. Entry into the promotion is deemed acceptance of these conditions of entry.
  2. The promoter is American Express Australia Limited (ABN 92 108 952 085) of 12 Shelley Street Sydney NSW 2000
  3. Entry is only open to individuals aged 18 years or older of Australian residency residing in New South Wales, Australian Capital Territory, Victoria, Tasmania, Queensland, South Australia, Northern Territory and Western Australia, who are the Primary Account Holder of an Australian Dollar consumer, small business or Corporate American Express Card issued by American Express Australia Limited (the “Promoter”) or by any Licensed Network Partners of American Express Limited (“Eligible Entrant”). Cardmembers who hold an American Express Business Travel Accounts, Government Card or Corporate Purchasing Card are not eligible to enter.
  4. Employees of the Promoter and Beinteractive Pty Ltd (“Be.interactive”), their licensees, their agencies associated with this promotion, and their immediate families, are ineligible to enter.
  5. Promotion commences 00:01 (AEST) Monday 03/08/2009 and closes at 23:59 (AEST) Sunday 27/09/2009 (“Promotional Period”).
  6. In order to participate in the Promotion, an Eligible Entrant must first register for such participation. To register, an Eligible Entrant must log onto amexnetwork.com.au/spring and complete the registration process ("Registration"), including identification of the American Express Credit Card for which the registration is made (“Registered Card”). The Registration facility opens at 00.01 (AEST) Monday 03/08/2009 and closes at 23:59 (AEST) Sunday 27/09/2009. Each Eligible Entrant who registers for participation in the Promotion is referred to in these conditions as a "Registered Entrant". If a person has multiple American Express Credit Cards, a separate Registration is required for each Card.
  7. Registered Entrants must transact on their Registered Card during the Promotional Period for entries into the draw. An “Eligible Transaction” is a Card transaction excluding Cash Advances, Balance Transfers and Refunds made during the Promotional Period, at any participating American Express Merchant, in New South Wales, Australian Capital Territory, Victoria, Tasmania, Queensland, South Australia, Northern Territory and Western Australia, by the Registered Entrant. Only Primary Account Holders are eligible to claim a winning prize and all Eligible Transactions by a Supplementary or Additional Cardholder during the Promotional Period will be deemed as additional entries into the draw by the Primary Account Holder.
  8. Subject to the other provisions of these conditions, for each Eligible Transaction completed by a Registered Entrant, the Promoter will award the Registered Entrant one entry to the Promotion.
    • Any entry so awarded to the Registered Entrant will be deemed for all purposes of these conditions to be awarded at the time at which the Eligible Transaction is approved by the Promoter (“Approved Transaction”).
    • No entry for an Eligible Transaction will be awarded to a Registered Entrant if:
      1. the Eligible Entrant was not a Registered Entrant at the time the Approved Transaction was completed; or
      2. the Eligible Transaction was entered into by a Registered Entrant during the Promotional Period, but was not approved by the Promoter, for any reason whatsoever, until after the end of the Promotional Period.
    • Registered Entrants will receive one (1) entry per Eligible Transaction at ANY participating American Express Merchant in New South Wales, Australian Capital Territory, Victoria, Tasmania, Queensland, South Australia, Northern Territory and Western Australia only, that accept American Express and as listed in the promotion pages on the amexnetwork.com.au/spring website.
    • Registered Entrants will receive TEN (10) bonus entries each time a total spend of $500 or more is spent in a single transaction at any of the participating American Express Merchants in New South Wales, Australian Capital Territory, Victoria, Tasmania, Queensland, South Australia, Northern Territory and Western Australia only, that accept American Express and as listed in the promotion page amexnetwork.com.au/spring website.
  9. There are no limits to the number of Eligible Transactions that can be entered into for the purposes of this Promotion.
  10. A Registered Entrant will only be eligible to win one (1) prize. A Registered Entrant, who is a South Australian resident, is entitled to win more than one prize, subject to state regulation.
  11. The prize draw will take place at Be.interactive, Level 9, 155 George Street, Sydney NSW 2000 at 3.00pm on Friday 30/10/2009. The winners will be notified by phone and email within 2 days of each draw and their names will be published in The Australian on Wednesday 18/11/2009.
  12. t is a condition of acceptance of the prize that the winning Entrant’s credit account must be current (during the Promotional Period and at the time of the draws) and the winning entrant must not be in default under their credit contract.
  13. There will be ten (10) prizes, each includes AUD$10,000 worth of Westfield Gift Cards and a Personal Stylist valued at up to AUD$1,000, to be spent during a one day shopping spree at a Westfield Shopping Centre of the winners choice. It will be the winner’s responsibility to travel to and from their selected Westfield Shopping Centre on the day of the shopping spree. The value of each prize is AUD$11,000 (inclusive GST).

  15. Ten (10) x Back-Up Winners will be recorded in the order drawn and used only in the instance that the relevant Prize Winner is ineligible, and therefore unable to receive a Prize. Prizes will be allocated to Back-Up winners in the order in which they were drawn. A Back-Up Winner will not receive a Prize, except pursuant to this clause.
  16. Total maximum prize pool for the promotion is valued at up to AUD$110,000 (inclusive GST).
  17. The Promoter’s decision is final and no correspondence will be entered into.
  18. The Promoter accepts no responsibility for any variation in any prize value. Prizes are not transferable or exchangeable and cannot be taken as cash in part and/or in full.
  19. No responsibility is accepted for late, lost or misdirected entries.
  20. All prizes must be claimed by 5.00pm (AEST) on Monday 15/02/2010. If any prizes remain unclaimed by this time, the Promoter will conduct such further draws at 3.00pm (AEST) on Tuesday 16/02/2010 (”Unclaimed Prize Draw”) at the same place as the original draw, subject to state regulation. A winner will be notified by mail within 2 days of the draw and their name will be published in The Australian on Friday 5/03/2010.
  21. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of taking or using any of the prize, except for any liability which cannot be excluded by law.
  22. The Promoter and the licensees are not liable for any tax implications (including any Fringe Benefits or Personal Income Tax) and Cardmembers should seek their own independent financial advice.
  23. If for any reason this competition is not capable of running as planned for reasons including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right (subject to any directions given under relevant lottery legislation) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the competition.
  24. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including but not limited to any injury or damage to participants or any other person’s computer related to or resulting from participation in or downloading any materials in this competition.
  25. The Promoter reserves the right to request the winner to provide proof of identity and residency prior to awarding the prize. Identification considered suitable for verification is at the discretion of the Promoter.
  26. In the event of war, terrorism, state of emergency or disaster the Promoter reserves the right (subject to any directions under relevant lottery legislation) to cancel, terminate, modify or suspend the promotion.
  27. Privacy Consent. To provide this competition, the Promoter needs to collect personal information about the entrant. If the entrant does not provide the information requested, the Promoter may not be able to provide the entrant with the competition entry. The American Express Privacy Policy Statement sets out policies on management of personal information. To arrange access to your personal information, request a copy of the American Express Privacy Policy Statement or enquire generally about privacy matters, write to the Promoter. The entrant agrees that subject to the Privacy Act, the Promoter or their agents may do the following:
    • Transfer personal information confidentially to the Promoter, its related companies or organisations that provide services in relation to this competition. This includes transferring personal information to the USA or other countries for data processing and servicing;
    • Request verification of Entrants’ account status and/or personal information from the Promoter’s Licensed Network Partners;
    • Disclose entrants' personal information to State and Territory lottery departments;
    • Publish winners' names as required under the relevant lottery legislation;
    • Use the winner's personal information in any media for publicity purposes associated with the competition without any further payment or other compensation, unless the winner otherwise notifies the Promoter at time of accepting the prize.

I will stick to my guaranteed win per tx by using my KF card (ie I 'win" an extra 1.5 points per $),
 
All 4 cards (2 main, 2 supp) in our posession have been duly registered. :D We do tend to shop a fair bit at DJs' so this works for us. Pity it ain't of the bonus points variety though.
