But be very careful. I know not the same but if a bank kept depositing money in your account and you kept spending that money then you could possibly get yourself in trouble if they decided to take action. That may not be the case here but you could potentially get yourself banned from Bankwest and/or QFF for life.

And I'm no expert. Just thinking out loud.

What, get banned because BW keep depositing points? Once is a mistake, this isn't.

Yes, people have got into trouble by spending money that arrived in their accounts, indeed in one example I believe someone was jailed. But the difference is that this is not money and QFF would have great trouble making a case that QFF points have value when their T&C's explicitly state that points have no monetary value. Courts tend to take a very negative view on making such claims and then attempting separately to claim that points do have monetary value.

Also BW would have great difficulty running the line this is accidental given they keep on doing it. The first time might have been a mistake, failure to fix a problem they are well aware of is a deliberate business decision (probably more expensive to fix). The law may well have sympathy for mistakes, they don't have sympathy with organisations who know they have issues but just fail to fix them (and try and blame the person receiving the points).

Note: I have no skin in this game anymore, and aren't one of those receiving points. But don't have a lot of sympathy for BW given their recent history.

If it's the same person who used to post here (and I apologize if I'm way off, I don't read OZB) they had a bizarre obsession with Qantas <redacted>. I'd say they felt someone was hurting their beloved Qantas and took it upon themselves to be the one to "rescue" them.

If you have something to say to someone, then say it to their face, and mention their username.

It seems that you need to re-learn the lessons of your grandmothers - if you don't have anything nice to say, say nothing at all.

the points may not be able to be given a direct $$ value, but they do have 'value' to redeem awards and other products. This list ion has been supported by courts.

perhaps in the same way if a bank or person repeatedly deposited money into your account, it doesn't matter how many times they do it, it's still not your money to do as you like with it.
 
When windfall points have been credited in error in previous months, how long has it taken the points assigner to claw them back? Or never?
If the points balance becomes less than the amount credited in error, does that prevent or frustrate the clawback? Are there any partial clawbacks?
 
In a nutshell - yes. I don't believe QF allows a points balance to go into negatives, and hence any attempt at reversal from BW will fail.
 
I just had a bit over 15,000 QF points clawed back from BW... Not very happy as I haven't been running any scripts in the past few months. They didn't take all my points so not sure what they are doing...

Yes it is. I have parked some spare cash in there that gives me about 8000 points a month. Not sure if they will come through this month now either.

It annoys me as I did the right thing when they accidentally posted over 200,000 points a couple of months ago and left the points alone allowing them to claw those points back as they were credited by accident. Has been nothing else happening in last couple of months so not sure why now they are debiting a pretty random number of points.

I guess I can transfer points to family to be safe or close BW account and try to open another.

Yes, they do move in mysterious ways. Why your account escaped the net and others didn't is just one such mystery.
They have also been clawing back some of the "windfall" points today, the ones that have been arriving in people's accounts on a monthly basis since their accounts were closed. It is hard to argue against this, but if they start trying to take back the legitimately earned points, ie from transactions and account balances then that is a different thing. I have emptied my QF account of all but the windfall points.

FYI - BWA is a client of QF Loyalty and purchases the points from QF loyalty on a monthly basis. Qantas charge BWA for the points at the rate of $0.01 each.

There have always been 2 issues with all this;

1) The breach of the T's and C's of the BWA account. (Multiple cards, $0.01 transactions etc)

2) The breach of T's and C's of the users QFF account.

In the case of 1) BWA can shut down anyones account for any reason they see fit.

In the case of 2) QF Loyalty can claw back points that they deem to be obtained in a way they don't approve of.

Before anyone gets too excited, there are not many of these BWA QF accounts in the market (A few thousand at most). The data is easily available to the BWA product manager and anyone with basic MS Excel skills can easily identify the outliers. In this instance, those who have accrued hundreds of thousands of points on a transaction account will stand out like a beacon.

This account was costing BWA a lot due to the misuse of the account and breaches of the T's and C's. QF Loyalty will always work with their clients with issues like this given the high cost involved and the clear breaches and misuse.

No one has been mistreated and BWA and QF acted ethically and fairly.

BW just clawed back 2 months of points from me. November was transferred out when it landed. December I didn't touch but transferred some other points back into my account and then a total of 95k gone today.

A bt dissappointed but you win some you loose some.
