Counsel for Home Affairs says he has instruction from Min for Immigration that he may exercise right to cancel visa on other grounds.
Judge Kelly didn't sound too impressed by that whole idea, as he knows that he will most likely get recalled back to court on his summer holidays.
 
Alex Hawke (Scott Morrison) is the minister involved I believe. We await a statement I guess from him.

The Guardian suggesting it’s a procedural win, because they didn’t wait an extra 48 minutes?

The minute notes Djokovic was allowed until 8.30am when he was originally detained to response [sic] to the notification to cancel his visa, but the decision was made at 7.42am.

  • The reason for this is the government acknowledged it didn’t give Djokovic enough time after notifying him of the intent to cancel his visa to speak to others and respond fully.
  • Notwithstanding that, the immigration minister, Alex Hawke, can now personally intervene and decide to cancel his visa anyway on entirely new grounds. Which the government flagged in court may be something that happens.
  • If that happens, it could end up back in court because Djokovic would face being banned from Australia for three years if the minister decides to cancel the visa.

In my opinion, I think that shall we call it the "centre court" of public opinion might be swinging away from the Government kicking him out now.

It feels that if the Gov try to deport him on s501 personal power of the minister that it's not abiding by the ruling of the umpire and shall we say is poor sportsmanship?

Hawke has until 9.16pm to make a decision it he is going to cancel the Visa.
 
Just another farce by the feds. Who would have thought there was an election due this year eh?
...or another example of the law only applying to those who cannot afford to challenge anything they do not like and who cannot afford the lawyers to ensure (in)equality under the law.

So a procedural issue only and no decision (so far) on whether he actually should be excluded under the law.

Yep, and the government can issue an order within an hour to have him detained again if they choose under the ministers personal discretion.

So the substance of the exemptions etc wasn’t argued it was a procedural stuffup that got him off.

Not sure its swayed that much - more like incompetent public service stuffing up procedure, judge never got to judge the case.
 
The election to me seems completely irrelevant. Maybe it will be up to the crowd to administer karma.
If he gets to any of my ticketed games including final I refuse to go. It’s disgusting TA attempted to support players in this farce by the ‘ATAGI defence’. Shameful…
if not for vaccination there would be no Aus Open.
 

Who is Alex Hawke? The politician who could decide Djokovic's fate​


Mr Hawke has served as Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs since December 2020.
He also now has the power to exercise his discretion to cancel Mr Djokovic’s visa.

Asked about Djokovic's vaccination status back in October, the Minister said players would not be able to enter the country and compete in the Australian Open unless they were fully vaccinated.

"Our health advice is that when we open the borders everyone that comes to Australia will have to be double-vaccinated," Mr Hawke said.
 
At this stage, and as much as I would love for the Djoker to be excluded for 3 years, I think the pleasure of watching him get booed wherever he goes for 3 weeks, including throughout every match and interview at the Open, is almost as joyous
