Cancelling ticket when airline changes times.

How do I stand with regards to a Jet Airways flight booked thru Expedia (Yes, I know... sigh..)
Jet Airways have cancelled the flight I was on, and now Expedia want me to accept the new departure times - which don't suit my time table.
Rules state tickets are non-refundable, I understand this if it was me changing my mind, but this is the airline making the changes.
Your thoughts please so I know where to swing my bat.

I have cancelled a number of bookings over the years due as a result of involuntary changes. I have not been in your situation as I do not book with third parties, only ever direct. Just refuse to accept the change and be prepared to go in hard and argue with them, if that is what is required.

I have never dealt with Jet Airways however have argued the toss with a few other airlines in my experience the CC agents will just make up stuff and cite rules that sound official but are utter nonsense.

If you have booked with a credit card you may have an avenue to dispute the charges under the "non-delivery of goods and service" bi-laws. They are called different things across Visa, Mastercard and AMEX but all essentially mean the same thing. I have only had to do this once however was successful. All the institution wanted was the the details of the original purchase information and the cancellation details and a statement to the effect that merchant could not provide a replacement service commensurate with what was agreed in the original purchase/ sales contract. This approach can take a while to get your funds back.
 
How different are the timings? The longer the better to strengthen your argument.

If they insist on offering you an alternative flight know exactly what flights are available in that approximate time and what is/isn't suitable.

Preparation will demonstrate that you're not to be stuffed around and know your rights.

As hvr points out, a lot can depend on whether it is a 'material change'. If yes, refund should be due. If not, might have to argue the case.
 
Agree it will depend on time difference and airline policy.

AA I had a huge brawl with regarding flight time changes (despite a published policy).

QF I recently cancelled a BNE-MEL after 2000hr departure changed to 1900 (and I wasn’t going to make the 1900!). They had no later flight so were agreeable to a cancellation without much drama.

If the timing change is small (sub 2hrs) they will often say no unless you can demonstrate it’s material (eg. My example with QF above). But a 1300 to 1200 might not have been so easy (but then, there probably would have been a 1400 or 1500).....

Cancellation means non-operation of a flight which was previously planned to be operated and on which, at least one place was reserved for a passenger.

b)Refund of air ticket and INR 7,500 or booked one-way basic fare plus airline fuel charge, whichever is less for flights with Block time of more than 1 hour and upto 2 hours.

c)Refund of air ticket and INR 10,000 or booked one-way basic fare plus airline fuel charge, whichever is less for flights with Block time of more than 2 hours.

d) In addition to the above, Jet Airways will provide meals and refreshments free of charge if the guest has reported for the original flight and are waiting for the alternate flight.

The compensation amount shall be paid in cash, by bank transfer or with the signed agreement of the passenger in the form of travel vouchers.

[Block time is the total time from the moment an aircraft first moves for the purpose of taking off until the moment it finally comes to rest at the end of the flight.]

Jet Airways is not liable to pay compensation in the following events:

No financial compensation shall be payable to you, if you have not provided adequate contact information at the time of making your booking or when you are issued a ticket for firm travel on the selected flight. In such a case, Jet Airways will either refund to you the ticket price or make reasonable endeavour to make alternate travel arrangements as per your choice. If you elect to travel to your destination on an alternate flight, Jet Airways shall provide you with meals and refreshments in relation to the waiting time at the airport.

b) If the cancellations occur due to extraordinary circumstances beyond the control of the airline (as described in Para 1.4 and Para 1.5 of the CAR) even if all reasonable measures had been taken by the airline.

Thankyou everyone for your “CHOICE’ words.
Called them this morning, flights cancelled, full refund, but will take 26 business days for refund to hit my Amex card. Good thing it is only $600.00
Flights rebooked direct with Air India, at the departure time that suits us from KTM.
