Unsure of a Visa Waiver Question

Can someone please help. The visa waiver states "have you ever violated any law related to possession, using or distributing illegal drugs"?

My brother wants to go to the US. He was caught with a small container of marijuan_ 4 years ago and the paperwork states that he was placed on a good behaviour bond under section 10 (1)(b) for twelve months. It also states that he was not convicted in relation to this offence.

Would he need to state "YES" to this question if he was not convicted nor is it listed on his personal record?

It doesn't ask if you were convicted, it asks if you have violated the law.

Therefore he has to tick yes.

However, advice provided on an internet forum is worth what you pay for it.

Seek specialist advice from an immigration lawyer.
