Southwest Airlines: Breakdown is now an act of God

Sue, asking their legal team to unequivocally prove the existence of God.

Now that would be a great legal case.

I am sure that this is just a LCC trying one on and I don't think it will ever be used legally.

Suppose my new God is a machinist at a Boeing factory in Seattle then.

I have an (somewhat cynical) hunch that this is about limiting liability in the event that a plane crashes due to mechanical failure. The argument goes that the passengers (or their families) will be unable to sue to airline for negligence because it is (supposedly) an Act of God.

Depending on the maintenance regimen they use I might have some sympathy for that view...

We used to do pro-active parts replacement or systems maintenance based on manufacturers "MTBF" (Mean Time Between Failure)... and a few other factors....

If an airline had a similar (and I only mean SIMILAR) approach then I would be sympathetic to the view that unexpected equipment failures are in fact not really their "fault"....

YM as always MV......

It's simple, when a plane breaks down sue them because they had not been keeping god happy.

God does not ask for much except for people to attend church once in a while, and to follow some basic rules. I wonder how many south west employees fail to go to church?

Whilst they may not be able to predict when god will do something to their plane, they can certainly mitigate that by following some of gods basic requirements, which I doubt they are doing... :D

Clearly they are not slaughtering the goat in the correct manner before draping the entrails over the plane. It's very important to get these things right, for everyone's safety. :p

Apparently* the legal staff SWA employed to rewrite their T&C used "off the shelf" prose to give a completly different meaning to the one intended.

They have now rewritten them, changing:
...
Force Majeure Event: ... Event ... outside of Carrier’s control, including, ... mechanical difficulties ... not reasonably foreseen, anticipated or predicted by the Carrier.
to:
...
Force Majeure Event: ... Event ... outside of Carrier’s control, including, ... mechanical difficulties by entities other than Carrier ... not reasonably foreseen, anticipated or predicted by Carrier.

*Well that's the SWA version.
