    VISA Waiver Program to USA

They should grant an extra year expiry date on everyone's visa due to the pandemic haha. Wishful thinking! :(

Criminal record and obtaining a US visa

How long did it take from mailing in your passport to receiving your visa in the mail? Thanks

Criminal record and obtaining a US visa

Did you find the second one easier? Did they ask you much?

Criminal record and obtaining a US visa

I was the complete opposite. When I went through immigration in Hawaii it was the quickest out of the lot and the lady was very friendly and even was nice enough to strike up a conversation with me.

Hey, yes it was really good and yes, that's the process.

Criminal record and obtaining a US visa

The majority of people in this thread have been successful, including myself (that have waited the 5 years and not had any major convictions)

Criminal record and obtaining a US visa

I suggest your best bet would be to speak to an immigration lawyer specialising in U.S immigration as this is a tough one. As far as I'm aware, any moral turpitude crime that has occurred less than 5 years ago requires a visa but in relation to "spouse of US citizen", I have no idea and no one...

Criminal record and obtaining a US visa

Hence why applying for a visa is so imperative these days.

Criminal record and obtaining a US visa

Sure is. Mine was a summary offence with no conviction recorded. I was just given a warning and I still had to wait the 5 years. I remember emailing them about 1 or 2 years after the offence and they told me it will be 5 years. But like I said some people on here have also had very minor...

Criminal record and obtaining a US visa

If a conviction was recorded they are going to make you wait 5 years from the expiry of Section 10 but you can try ealier obviously. Several people on here have not waited the 5 years and still been granted a visa.

Answers in BOLD above. These answers are just my opinion but I speak from experience as I have been through the visa process etc.

No. You must have a passport but I'm sure there are many other wonderful places you could and will want to go to so it's always beneficial to have a passport :)

Criminal record and obtaining a US visa

I can only speak from experience that I applied for a visa this year and it only took me 4 months to receive it. I was expecting it to take 6 months after following this forum but was pleasantly surprised when it came 8 weeks earlier than expected.

Can I ask why you were denied 12 months ago? Was it under the 5 year waiting period? Congrats on getting your current visa. I can only speak from experience in Los Angeles. You will be asked to stand aside once the customs officer finishes up processing your passport, visa etc. Then you will be...

    VISA Waiver Program to USA

Re: USA Visa Waiver approved - but just charged with a crime after The best thing to do would be to either a) contact a immigration lawyer and ask them if it comes under MT or b) Speak to the US embassy and ask them! I would suggest doing b) as they would know 100%. You will need to find out...

    VISA Waiver Program to USA

Re: USA Visa Waiver approved - but just charged with a crime after Because you have already admitted to the embassy of an offence, whether you get a conviction or not will not matter. You will still have to apply for a visa.

Criminal record and obtaining a US visa

You would have to look at each countries entry requirements. I don't believe he would have any problems entering any South-Eastern Asian countries or some Europe countries but would definitely have to apply for a visa to New Zealand, U.S.A, Canada and the U.K and other countries as well. If...

    VISA Waiver Program to USA

Re: USA Visa Waiver approved - but just charged with a crime after You would really have to wait to see the outcome of your court case I'm afraid. You probably shouldn't have booked tickets until your court case is finalised. What application did you put on hold?

Criminal record and obtaining a US visa

Very true. It certainly is a very rare case as personally I have never heard of this happening but good on the OP for not having to now wait the extended period of time to get their visa!
